No, usually the old mortgage company has the NEW mortgage company write to the insurance company DIRECTLY, and change the mortgagee clause. The agent doesn't usually do it - the mortgagees do it.
They DON'T need your permission - you signed that right away to the mortgage company, when you borrowd the money from them.
An agent can't "charge" the mortgage company for insurance. They can't issue the policy without getting a WHOLE BUNCH of personal information from you. SOMEONE told him to issue the policy - either the mortgage company, the closing agent, or you, and maybe you later changed your mind. IN any case, once the FIRST person says "issue the policy" and the agent binds it, you can't UNISSUE the policy legally, in Texas. It WILL get issued.
If you had coverage in place with ANOTHER insurance company, just send a copy of the declarations page to Harrison, and they can cancel THEIR policy "flat" and fully refund your mortgage company. |

As long as you had a contract with him to provide insurance and gave him prior authority to do so yes he can. The way to make him stop is to send him a letter asking him to cancel the account and stop drafting the payments immediately. |

If this was communicated to the closing attorney, then the binder would not have put the coverage into effect. You can still cancel and use your own coverage and get your premium dollars back. |

At some point, someone signed an application and it was probably sent to the company before you told them you didn't want insurance with them. Once an application is sent to the company, you can't just verbally tell an agent you don't want the policy. Cancellation requests must be in writing. Call the agent, tell him you want to cancel the policy flat, he will send you a Lost Policy Release/Cancellation request form which must be signed by all named insureds. Return it to him with a copy of the policy you obtained instead of his so that the policy can be cancelled flat. You may or may not have to have the mortgage company sign it too - depends on the company (our companies used to want it but they don't require it anymore). Good luck. |
