I bought my first (and only) vehicle a year ago, and purchased insurance through State Farm. My husband has a company truck and company insurance, but since we share the same address they told me I had to put him on my insurance anyway.
Not a big deal. But about a year and a half ago (before I even bought my car/insurance) he got a ticket in another state. So in order for the ticket not to go on his record, he paid to take a safety driving course, and also paid about $200 for the ticket. Now my insurance company sends me a notice that my rates are going to be affected by this ticket that my husband got before I even purchased insurance with them.
At the time of the ticket I was still on my in-laws insurance and having to borrow their car because I was trying to pay for school. So...why are they able to "adjust" my rates after I've been with them for a year knowing full well that the ticket occurred before we purchased insurance through them??? Additional Details I UNDERSTAND ABOUT THE TICKET...but why wait a YEAR after I got insurance with them to tell me that my rates are going to be higher than what I initially agreed to. I have already paid my insurance twelve months in advance and now they are asking me for MORE money when they should have saw the ticket BEFORE I even purchased insurance. That was my main concern, that they waited until NOW, a year later to tell me that my insurance would be higher. |

The ticket stays on your record for 3 years in California. Either the court never got the traffic school information or he got a 2nd ticket. Call the court to see if they got the traffic school information. And, then call the traffic school and let them know the court never got the information they needed. Find out what you need to do to get the ticket removed from his driving record.
After you get the ticket removed from his DMV record, call your State Farm agent and let them know. They can call their underwriter and the underwriter will run his DMV record to see if the ticket was removed and if it was State Farm will stop charging for the ticket and give you credit back to the time they started charging for it.
One other thing is some tickets State Farm will not charge for like if you are a truck driver and got the ticket while working. So, call and ask about that too.
Some things vary by state.
Why did they wait a year to charge you for that ticket? When they ran your DMV records a year ago he had not paid for the ticket yet. The ticket does not get recorded on your record until you pay for it or show up in court to clear it. Now that he has done that it is now on his DMV record.
So, call your agent and ask what the date of the ticket was and what the conviction date is. The conviction date is the date he paid the ticket or showed up in court. I bet its after you took out the insurance. |

Tickets stay on your insurance via surcharge, for anywhere from three full policy years, to seven, depending on what state you are in.
They can adjust your rates, because YOU failed to disclose the ticket, and it's subject to surcharge. Think about it. If they only could surcharge for things that happened during their policy, everyone would cancel the policy every time something happened, and no one would EVER have a rate increase for poor driving.
They waited the year, because many times, it takes 3 - 6 months for the information to be sent from one state to another - and typically, the insurance company only runs the driver checks when the policy renews. Because it costs them money. So, your policy came up for renewal, 120 days in advance, they run the driver check, bang, here's a violation, oh, it should have been applied to the prior term, but only hit the driving record six months ago.

Consider yourself lucky that it wasn't found out earlier, the good news is that the ticket falls off of your insurance 3 years after the date of occurrence. So, you're complaining because you haven't been paying these rates the entire time? I would also be curious to see which state you are in, because most auto policies with State Farm are 6 month policies. Regardless of what traffic classes your man takes to lower the severity of the accident/ticket, as long as there was some sort of payout to another customer, you have to be surcharged for the ticket/accident. |
