Yes they can.
They invoke the contestabilty clause most often when a policy holder makes a material, misleading or fradulent statement on the application.
The contestability clause is to help prevent from having to pay out on fraudulent claims and it helps keep down the cost of premiums for the rest of us. |

Just because it is a contract does not make it 100% enforceable. There is wording in the contract that will allow the insurance company to contest. The biggest reason they can contest would be material misrepresentation. For example - say you died of cancer. You did not disclose the fact that you had cancer when you wrote the policy (even though you knew). Had the insurance company known they would not have written the policy. That would be misrepresentation and therefore a reason to contest the policy. |
