Can anyone other than named beneficiary collect on life insurance policy? I live in Texas?
This is the senenario. My girlfriend purchased a life insurance policy and named her boyfriend as sole beneficiary. She is still legally married, however seperated. If both, the boyfriend and the husband are still alive when she dies, will the husband still be considered the beneficiary at time of her death? This is what she was told by a well meaning friend..

No, the beneficiary is who the policy owner names, period. Her husband will have no claim on the proceeds of the policy should she die. Just as she could name a family member or friend.

Key man insurance pays a company if a critical employee or executive dies because the company would be crippled by their loss. It is solely up to the policy owner who has beneficial interest in a life insurance policy.

The only argument the husband could make in probate court would be that she changed an existing policy under duress, taking his name off and adding the boyfriend. If she bought a new policy, he doesn't even have that claim.

This is a real gray area and really requires an attorney to answer definitively.

A more clear situation will arise when she files and receives a divorce.

Talk to an attorney. It is better to clear up the situation now while she is alive then to spend endless hours in probate court fighting with her husband over the life insurance benefits after she is dead.


Gail, it is unclear in reading the question as to WHEN she purchased the policy. In any case, she is still legally married. State laws vary on the beneficiaries of life insurance policies after a divorce decree - even when the owner does not change the beneficiary designation. Nonetheless, this is a legal question best answered by an attorney. The situation will become abundantly clear when she is divorced.

The named beneficiary is the person who will collect. If she wants someone else to collect on the policy, she needs to change the beneficiary on the policy.

Insurance Companies are regulated by each state. Generally, if its a community property state, then a good chance the husband can touch the death benefits. If not, the girlfriend (wife) can do whatever she wants.
I lived in Texas years ago and I don't believe it was a community property state like WA or CA. But even in a community property state, if a wife takes out a life insurance or even on her 401k, the spouse is the default beneficiary UNLESS a specific beneficiary is named on the policy.

So, I would suggest the following:
1. Confirm if Texas is a Community Property State
2. Review the policy and see who is listed as the owner and insured
3. If you're name and ss# is listed as the beneficiary
4. Check your Insurance Commissioner's website
5. Then if its still not clear, check your local courthouse for a 30-60minute free consultation with FREE volunteer attorneys and they will let you know if it something you will need to take to court or if simple state laws will rule.


Doing the Right Thing
Only the beneficiary can collect the death benefit. The owner of the policy (which is your girlfriend) MAYBE able to change the beneficiary, that is, if the beneficiary is revocable. If your girlfriend was to die accidently tommorow, the person named as the beneficiary will get the death benefit.
