i am a truck driver and have been taken out of work by the MIDOT and my company has all the paper work to prove this, however they are talking about terminating me because I have been out of work for longer then 30 days. On the paper work it says that I am to be out for six months, which puts me back to work on the 18th of Feb. 2007. Can you help me with this problem, I want to know if they can leagally do this. |

Usually, yes they can. (Although, most states have differing laws on this and yours may be more protective).
You have to remember that the idea of short term disability is to simply pay you for being off work. It is not, as some people may think, an excuse for missing work.
The contract between you and the insurer is to pay you for being off work.
The agreement you have with your employer is that you will show up for work, do the work and get paid for it.
If you can't commit to your end of the employment agreement, then they can get rid of you.
Which is why it is so very important as an employee to seriously buy as much short and LONG term disability insurance as you can afford.
If this happens to you and you are disabled long term and lose your job, you'll still get at least some income without having to apply for federal disablity from SSI. |

Everyone can give all this great advice to you ,,but remember this,,if you sue you will be in court for years and you may starve thats their ploy they will starve you out until you are forced to take any job, the company always has you by the balls try to get better if possible if not, prepare for a long suffering time |

I think it depends on afew things.....Do you have a union?....what is your record like?Are they looking for an ex cuse.Go online and check the labour laws.they should not be able to fire you out on disablity but they could find a reasone after you come back |

According to the Americans with Disabilities Act, you cannot be fired if you have a disability because you have to request for alternate accomodations. MIDOT is firing you because you did not ask for alternate accomodations. I would hire an attorney and stop the termination in Federal Court. |

Well for sure they can't do it before 12 weeks due to FMLA but I think it's illegal to fire someone while they are on temporary disability thanks to the american's with disabilities act. Call a disability attorney and ask. |
