Check the workers comp system where you live. In many places, violence at work is a compensable injury claim. |

Look on the unemployment office web site for your state. It may be too late for you to apply, as it has been over a year since you last worked. |

The short answer depends on what state you live in...and your caseworker (to be perfectly honest.)
Know this; the state will question you why you didn't quit immediately, what did the employer do for you, and why did you return to work? While it sounds a bit rough, I feel for you and just want you to be prepared. After all, it IS the state you are dealing with and they have laws to abide by - never forget that.
In the meantime, it doesn't sound like really have any injuries (although your ordeal is terrible!), so your best bet is to return to a SAFE job.

It might be too late to file, check the laws in your state.
If you can get a psychiatrist to write a note stating that you had no choice but to quit your job due to a serious psychological reaction to the incident, you can collect.
However, at this point, it is likely too late. In order for the "quitting for medical reasons" argument to be effective, it has to be valid, and well documented. Waiting over a year to see the doctor won't hold up.
I quit my job because of a medical condition, and was able to collect unemployment. I'm sure it varies from state to state, but it can be done. |

why havent you worked since then ? was the injury that bad? I thought that unemployment was paid out if you were fired. I dont think that you will be able to claim injury since you returned to work and then quit. it has been a year.try finding another line of work. |
