i live in nyc and i came back from vacation my employers whom i told them in writing that i will be away on vacation never responded. now they are refusing my vacation pay leave alone that i have to fight for my unemployment benefits. any help much appreciated. thanks in advance. |

If you worked there for a year and met their requirements, sure you can. If they won't pay, take them to small claims court. |

Why did you tell your employer in writing? Was your job such that you do not see your superior for long periods of time? Does your boss not have a phone?
Vacation pay is a benefit, not an entitlement. If you did not take the proper steps to get your vacation approved then you did abandon your job, and you are not entitled to vacation.
Maybe if you elaborate on your situation we can answer you better. |

Call the Labor Board or Employment Office in your state for help.
They will tell you what your laws are. |

amy and a couple others are all right.. you have to request the time off and it must be approved before you can take the time off.. you can't just submit a request and then take the time off.. Most companies have a vacation request form that you submit.. |

Unless you have proof of requesting the time off, it's your word against his. Since you put the word abandon in the question here, I think maybe you should work on your story before you talk to unemployment...abandon doesn't make a good case for you at all. |

Apparently your company did not agree with your taking your vacation at the time you did and fired you. The reason probably was for job abandonment.
I can see where you would not be entitled to unemployment benefits.
If you were entitled to vacation pay, yes, you will have to fight for that. |

Even if you notify a company in writing that you are going on vacation you basically are only requesting that you can go. If they never responded you should have been responsible enough to call or speak to someone in person.
Basically in there eyes you, like you said, abandoned your job and they owe you nothing for your vacation but you'll probably get unemployment if you worked long enough and have paid enough in. |
