Misconduct/violation of company policy is grounds for firing AND for denial of unemployment compensation benefits. The purpose of unemployment compensation is to provide financial assistance to those who lose their employment through no fault of their own. Sounds to me like it may have been your fault you lost your job. |

If you were fired by your employer, you will not be able to get unemployment benefits right away. You can apply for a hearing , and there will usually be a 3-way phone hearing between you and your previous employer and an unemployment compensation representative. After the hearing, you will be advised in writing of the outcome.
Sometimes you are denied benefits altogether (like if you're caught stealing from your employer), and sometimes you are required to wait an extended period without pay before benefits begin. Sometimes, they will set a lower time frame during which you can receive benefits.
You request the hearing through the local unemployment office. |

When released for disciplinary purposes when employment is available, unemployment is not allowed in any state. Sorry to hear of your dismay. In today's age, society itself would never be eligible! Good luck in your future endeavors. |

If you were fired for misconduct you are not eligable for unemployment... even if you fight it you will not get.My Father went through this about a year ago after being let go from a temp job because he got in a arugment with a manager. |

Being rude is NOT considered misconduct. Misconduct is creating a dangerous or threatening environment for yourself and coworkers or customers. You need to find out exactly what was in the complaint. It could be that your employer was looking for a reason to get rid of you, and that was it.
If your employee said the cause was misconduct, you will need to show that it was not.
In addition, if they're saying the cause was misconduct, especially if they say gross misconduct, you won't be eligible for COBRA either. |
