Allstate was my insurance company and i have not missed a payment, they say i did not make a payment since May 30th, it is now July 15th and i know for a fact i made a payment last month (because i was 2 days late by accident, but there is a 15 day leeway), i dont know if there was an error on their site or what but according to my bank account they never did take the money out, even though i am 110% sure i made the payment online, why it did not go through is beyond me, my point besides all of that is that i have been driving around without insurance for close to a month and they never did notify me, that is im sure extremely illegal and not to mention dangerous, so can i file a suit against them for it? |

If you made the payment on line - you should have gotten a confirmation. If you can not produce that confirmation ....you are S.O.L.
If the money did not come out of your bank....then the payment did not get made. They are correct.
When the money did not come out of your bank...you should have looked into the matter.
But, as it is, the policy was not paid if Allstate did not get the money and they did not. The only thing you can do is make sure that you get the policy paid back up and in force.
Next time you make an online payment - print and save the confirmation and put it in a file. |

Call them and talk about it. Obviously something happened between you and them while sending the payment. Bringing it to court will cost you time and money, and you have a very slim chance of winning anything. |

If you pay your bills online like I do you should print your receipts. If you have the receipt from the transaction, there's been a mix-up probably with your bank, not Allstate. They probably didn't get their money but that's not their fault. They should send you a letter of default. That's b.s. man. |

Sure you can, here in the USA you can sue anyone for anything.
But there's no "leeway" or "grace period" with auto insurance. If that was the cancellation date, bang, you're cancelled.
The way it works, Allstate doesn't have to be sure that you got the notification. All they have to do, is ATTEMPT to mail it to you. And it's all computerized, so you can be pretty sure that they can show that they attempted to mail to you - at your last known address - a late/cancellation notice.
Additionally, as you haven't actually had a monetary LOSS, you don't have any DAMAGES to sue them FOR. If you're driving around dangerously and illegally, STOP. That's silly. You can get insurance right now, from Progressive, at www.progressive.com. Now that you know you're cancelled, it's YOUR fault, for sure. |

No, you cannot. It is your responsibility to get the payment to Allstate and to verify that it arrived. Don't you ever look at your bank account online ? Or keep a check register ? A quick look at your bank account would reveal quickly that the payment was never taken from your account. Such things happen on occasion, and it's not Allstate's fault. You didn't pay, and they cancelled. |

But your real question is: "What are my chances of suing and walking away with at least paying nothing?"
And the answer to that question is "Slim to none".
Your situation does not add up. You need to fill in the blanks by contacting Allstate ASAP. |

Actually read your policy/contract, which is legally binding. If dont don't make premium payments your insurance coverage ends.
You say you are 110% sure you made the payment, however do you have proof? Did you get a confirmation or can you check you back account and see if it is drafted? Have you verified your payment? |
