KG | Can insurance companies deny coverage during open enrollment? |
I work for a college in Texas. Due to my husband changing jobs, I need to add him and our two kids to my medical policy. Colleges are exempt from adding at any time. I have had to fill out Evidence of Insurability for all 3. My spouse was denied because he is a diabetic and on insulin. His previous job he worked shift work and was unable to eat on a regular schedule so he has to be on insulin in order to keep his diabetes regulated. His doctor is going to work with him now to get him on pills. So, for now, he will have to go on Cobra. My question is can the insurance company still deny him coverage during open enrollment? Will it help change their decision if he can maintain his diabetes on a pill regiment instead of the insulin? I'm really worried about them denying him again. We have cobra for 18 months but if they deny him after that I don't know what we will do. HELP!!! Thanks! Additional Details I have checked with my HR Dept. and I have checked with my husbands HR Dept. both tell me he can't be denied during Open Enrollment. However, a representative from Fort Dearborn Life said he can be denied even during Open Enrollment. His last day at work is this next week. He will go on Cobra after that. His doctor is writing a letter for us to submit to the insurance company stating that the reason he had been on insulin is due to his shift work schedule. He never knew when he would get to eat so he couldn't take the pills as a set schedule, therefore he had to be put on shots. |

Your best bet is to talk with your Human Resources department and ask them. I don't believe they can deny you coverage but I am not sure about your dependents. Also check quickly especially if your husband has been without insurance for awhile. There are a certain number of days that you can be uninsured before they can deny a person for pre-existing conditions. |

I broker group benefits, and my recommendation is go straight to the insurance company member hot line: you'll find it somewhere on their website.
Couple reasons:
There's no universal insurance law that could answer your question, so the answer is going to differ depending on Insurance Company and policy type.
Your HR Department and/or Employer could be too busy to handle your question quickly, then it could be too late.
It's pointless to ask HR because: you'll ask HR the question > they'll ask the Group Health Broker > the Broker will ask the Insurance Company's Broker Support person > Broker writes down answer > Broker tells HR > HR tells you. Remember the children's game "Telephone" and how much the answer changed once it got full circle?
Edit: ask the broker instead of going direct if the company will give you his number. |

the purpose of cobra is so a sick person doesn't have to show proof of insurability but if your husband didn't go straight from his plan to cobra to your plan then your best get legal counsel |

If he's on a group policy, I don't think he can be "denied" coverage during open enrollment.
HOWEVER, if he has had a lapse in coverage between his old job, and the new job, of more than 63 days, they CAN decline to cover pre-existing conditions for 18 months.
So, was there a lapse in coverage? It sounds not, because of the cobra thing. Or I'm completely misunderstanding the question. |
