Unfortunately, if a person dies during the commission of an illegal act (in this case marijuana w/driving) then the company is no longer obligated to uphold its part of the contract.
Just as you have a war and nuclear disaster clause on many contracts, where exceptions to the rule are stated, this is also one of the types of exceptions to the contract.
But if she was just a passenger and not the driver, then you should still get the benefit - she wasn't responsible. Maybe the company doesnt buy your side of the story, as long as you have proof of this, you should be all set. |
