Can my employer discontinue my Health Insurance?
I have worked for my employer for over 6 and a half years. I have just heard that the boss might discontinue health benefits.. can he legally do this?

I have worked for my employer for over 6 and a half years. I have just heard that the boss might discontinue health benefits.. can he legally do this?

Addition... cne the insurance be cancelled anytime or does he have to wait until the renewal period? I am highly concerned about this as this is employer paid insurance and the wage he pays would not allow for me to buy my own insurance...

Also, a co-worker was denied insurance by him at one time because she was eligible for another job which she did not take... she recently agreed to stay, he dragged his feet for her insurance and then she was denied by the insurance co. for the length of time she was without insurance... does she have any recourse? (other than changing jobs)

Yes, he can legally do this.

Yes, employers are not required by law to provide health insurance- its a BENEFIT not a requirement. Now, bear in mind, if they discontinue, it has to be for everyone. They cannot stop offering it just to you because you have a sick child or something like that. But as long as its to everyone, then yes, they can stop offering it, and this is becoming more and more common given the high cost.

It is not required that employers provide health coverage for his/her employees. It may, however, be required that he provide you with substantial notice of terminating this coverage. If you do not receive at least 30 days notice of the loss of coverage, I would check with your State's Department of Labor.

The cost of coverage continues to grow at a rate twice that of inflation, despite eroding benefits and high deductible health plan options. Employers are running out of answers. Some are deciding to discontinue benefits - in fact, 20,000 employers did just that in 2005. Talk to your employer and ask if there are any other options. You would be much better off with higher copays or deductibles, or contributing a larger portion of the premium than if your employer discontinued coverage.

Yes, he can. He is under no legal obligation to provide health insurance to employees. If you are concerned about this type of problem, you can inquire to him if he would be interested in communicating with his employees who are concerned about this type of change.

Yes. The only exception to this is if he has a written agreement to the contrary.

Yes, your health benefits can be cut at any time. If they are, you can continue your coverage under the COBRA plan. This guarantees continued coverage—you can’t be turned down—however you premiums will go up, as you will be paying both the amount (if any) taken from your check plus the group rate your employer was paying. When COBRA coverage runs out after 18 months, you might be able to continue under a state program, such as California’s Cal CORBRA. When that runs out, you will need to find private coverage. The easiest thing to do that is to log on to a website like http://www.healthinsurancewiz.com and fill out a form requesting a quote. Your info will be sent to a health insurance broker in your area who will contact you. A broker works with several health insurance companies, and can find the best deal for you. Brokers need referrals and a good reputation to stay in business, so they only work with reputable companies. There is no charge for the service and no obligation to buy.

If you are reasonably healthy, ask about a High Deductible Health Plan (HDHP). As the name suggests, it has high deductible amounts, so it costs less than traditional health insurance. Under federal law, the minimum deductible in a HDHP plan is $1,100 for an individual and $2,200 for a family. The maximum deductibles are $5,500 for an individual and $11,000 a family.

The main advantage of an HDHP is that you can shelter up to $2,850 for an individual or $5,650 for a family per year from state and federal taxes in a Health Savings Account (HSA). Depending on your tax bracket and where you live, that could save you as much as $2,539 in taxes per year, assuming a combined tax rate of 424.02%—6.37% in state income tax (New Jersey), 28% in federal income tax, and 7.65% in Federal Insurance Contributions Act (FICA) tax. The contributions you make to an HSA are yours to keep, rolling over from year to year. The funds remain untaxed as long as you use them to pay medical expenses or withdraw them after age 65. The funds earn interest on a tax-deferred basis. Think of it as an IRA that you can use to pay out-of-pocket medical expenses.

Unfortunately, he can. Health benefits are a perk.
However, he should give you planty of notice so that you can find insurance and get in a few last doctor visits while you are covered. (Unfortunately, it will be higher as companies usually get a group rate and now you will have to pay an indiviual rate unless tou can obtain insurance through a labor union or professional organization).
