You haven't provided enough information to accurately answer the question.
What type of coverage is it?
If it is coverage that you obtain through your employer, then your ex-wife is not eligible. She should be removed from the plan as soon as possible - to keep her on would be insurance fraud, and your employer could take action against you (such as recouping what they paid out for your ex-wife's medical expenses, going after you for insurance fraud, disciplinary action on the job for you, etc.). Your biological daughter, however, should likely still be eligible. Your employer would be able to confirm that for you.
If it is a family policy through a private insurer that you purchased for all 3 of you as a "family," then no...your ex-wife cannot remain on the policy. You are no longer married, and therefore not eligible to be on a "family policy" together. (If the insurer finds out, they can rescind your policy and go after both of you for medical expenses paid out.) Once again, your biological daughter should still be able to remain on a family plan with just you...check with your agent to confirm.
The only way your ex-wife can legitimately remain on a "family" policy that you are paying for is if you purchased the policy specifically for just your ex-wife and child. You and your ex-wife cannot legitimately be covered together under the same policy, because you are no longer married.
If you're paying for a separate policy for only your wife and daughter, you should be good to go. If you and your ex-wife are being covered at the same time under this same "family plan," you're committing insurance fraud. |
