Can my health insurer consider mitral valve prolapse pre-existing if it was never treated before?
I just got health insurance on Nov 1st. There is a 365 day waiting period for pre existing condtions. I got sick days later & on Nov 6th went to a doctor.(palpitations) Never before this had I been treated or diagnosed with these symptoms. I was dx with mitral valve prolapse and dysautonomia in Dec. My insurance co is requesting records from the dr who dx me and the claim is pending while they investigate.They say the diagnosis code indicates that my condition may be pre existing. My policy states pre-existing as:
"any condtion,no matter how caused ,which you received medical advice,diagnosis,care, or for which treatment was recommended within 2 years preceding the enrollment date.Even if the condition was not diagnosed, they will treat it as pre-existing if symptoms before enrollment were consistent with the present condition. Of course, I know the mvp had to have been there , but according to their own wording, can they really rule it as pre-ex since I never went to any dr about it?

Just to be clear, the mvp isnt really a problem. It is very slight. In fact, a cardio told me a few weeks before this that i didnt even have mvp. It really needs no treatment, just need to drink more water. The real problem I have medically is the dysautonomia. It occurs sometimes suddenly with no known cause. It is not understood well and can act up suddenly and disappear just as quickly sometimes not showing back up for years. The treatment is beta blockers, which the cardio already had me on when he diagnosed me with benign pvcs(after I was insured)My only concern is now that this dr says I have mild mvp, they are going to try run them together and just deny the claim. The mvp isnt even what is causing my symptoms. But mvps are from birth, they may use the mvp as an excuse. I honestly doubted the dx of mvp when i got it. A really good cardio said it was neg. on the echo. My question is from their OWN wording of what a pre existing cond is can they legally deny it? never treated b4

I need to see the exact wording of the "symptoms" portion of the pre-existing condition definition. You write that symptoms are considered, but there's nothing in the contract language you've quoted so far that permits this.

I'll keep checking back to see if you've added this. If possible, could you quote the ENTIRE definition of "pre-existing condition," just so it's clear?

p.s. -- not all mvp's are from birth; some are aquired, for example following Rheumatic Fever. So a company cannot simply assume it's pre-existing and deny based on diagnosis code alone.

EDIT: Jenna, I saw what you're referring to, but the problem is, you didn't put quotation marks at the end of the definition. So I can't tell where the definition ends and your comments resume! If the quote should end after the word "date," I'd say the company cannot deny your claim as being pre-existing. You write you'd never had these symptoms before; that you'd never been diagnosed with mvp; and that you'd never received treatment for this. In this case, while your condition clearly pre-existed your coverage, it cannot be denied as a pre-existing condition since you truly didn't know you had the condition, nor did you have symptoms that should have lead a reasonably prudent person to seek care.

If the insurer denies these claims, contact your state's insurance commissioner's office for assistance.

EDIT #2: Thanks for posting the additional information. I believe this carrier would have no legal basis to deny your claim. In order to do so, it must prove you received care or advice regarding the condition. This is actually a very weak wording, since the pre-ex definitions I usually see include symptoms that would have caused a reasonable person to seek medical care or advice. (Insurers get to deny alot of claims because of that wording!) As I wrote above, contact your state's insurance commissioner's office if your claim is denied.

It's standard procedure to request medical records on certain codes and this request usually covers from 2-5 years worth of records. If you had any symptoms related to your heart or the condition, even if your doctor didn't tell you, your claim could be rejected for pre-existing. Some companies routinely deny a claim such as this, regardless of the medical information.

If they deny your claim, you can dispute and resubmit the claim, requesting another review--check the time limit for resubmission of denied claims--all companies have a time limit. But you'll need additional medical support for your claim...like your Dr. sending a letter along with medical records supporting his statement.

Prolapsed valve is a tough one to fight given your time frame. I'm not saying "it ain't true", but to an insurance co, 5 days from policy start to dx is going to look more than suspicious...it will look fraudulent.

Start looking into a back-up plan for yourself. My mother went for 14 years with a prolapsed valve before having it fixed...at her own expense. Talk to your dr about the options and the realities and risks. Sorry. Hope it works out for you.

i don't believe so. I also believe in fighting these insurers any time you have a question. I had an emergency that required an ambulance, and BC/BS tried to mark some of my stuff as non-emergency, and harge me for it. When I questioned it, my bill miraculously dropped $400 and was recoded, apparently due to their "system" it couldn't code everything as an emergency.

they may be investigating it due to thenewness of your insurance, but whatever yo do, DO NOT BACK DOWN!
