legally binding?
Can my husband's company not give us health insurance until we provide birth certificate for our daughter?
My husband was eligible for health benefits from his employer as of Oct. 4, 2008. It is now January 2009; and, they will not insure us until we provide a copy of our marriage license and a copy of my daughter's birth certificate. We did send them a copy of our marriage license and a copy of the certificate of live birth. They will not accept the certificate of live birth as a valid document. We still don't have insurance, they say, until we provide a copy of birth certificate-which I will have to send away for and pay a vital record fee of $20. Sadly, and honestly, before Christmas, we couldn't spare the $20. It just seems ridiculous to me that they are demanding all of this from their employee. It's not like we have to prove we are U.S. citizens: They already have a copy of his social security card...

They want proof that you are legally married and that child you are adding to the policy is your husbands child. They just want to verify that you and your child qualify for the benefits. Given the amount of fraud that happens ....not unreasonable.

It's probably a good idea to have a copy of your daughters birth certificate in the house. Keep it with your other important papers.

So...what would you rather pay: $20.00 to get a birth certificate and have health insurance or the dr bills when your child gets sick. Personally, I'd spend the $20.

They have every right to ask for you daughter's birth certificate. A certificate from the hospital is not a legal document and therefore not acceptable. In all frankness, they don't really care that it costs you $20 to get one. But in all honesty, you should have one in your possession. You will need it for many other reasons. Health insurance is a priority that should not be shirked. Without it, you will have much higher out of pocket costs than the cost of the birth certificate.

Your husband's employer and the insurance company do have a right to verify that dependents being claimed on health insurance are truly eligible for the benefits. So, if you want your daughter on the insurance, then you'll have to provide a copy of the legal birth certificate.

Unfortunately, its not the insurance company or your husband's employer's fault that you didn't have a copy of the birth certificate already. Every parent should have an official copy of their children's birth certificates - you'll need it for other purposes down the road anyhow.

Its a perfectly legitimate request for insurance purposes. You don't "have" to get a copy for them, but then they don't have to insure your child either.

I think they just want to make sure that you are legally married to him and that your child is his legal daughter. They don't want to put extra people on the insurance that shouldn't be there.

True, unless you provide proof that you are, indeed, his wife, and he's not making it up, AND, that this is your child, and his child, they do not have to add you.

This isn't his employer's beef, this is the INSURANCE COMPANY regulation. You need a real, live, certified birth certificate.

See, blame all those guys shacking up with their honeys - they've lied for YEARS to the employers, to get the girfriends and kids covered. So now EVERYONE has to pay for their fraud, by proving the marriage, and the birth.

I understand where you might be concerned about them asking for this. But usually insurance companies will ask you this info to make sure the daughter is his. Rather than an extended family members child that you might happen to be raising. As long as she is your daughter with him there shoudlnt be any problem. If she is yours from another relationship, you might want to check that he has right to her, which im not sure how you go about getting that taken care of.

Good luck!

Simple is as simple does.

They just want an actual birth certificate. That covers them legally and makes sure that there is no fraud. That covers you legally as well.

It is after Christmas. $20 for something that impacts everything for your child is not a big amount of money. It will be needed for all.

These documents should be readily on hand. If not, make sure they are for the future. Not only should you know where they are, but family should as well. They can ask, so just get them and get them back to them. The simple fact that it's 3 months later doesn't make it more of their fault you don't have coverage. They asked...now deliver and your problem is solved.
