Can my insurance company get away with this?
My payment was due November 20th and I sent the check on November 3rd. At the time, I made several checks, you know, paying bills and I didn’t notice but I sent my insurance check to a Charity (I have a little boy that I sponsor and every month I send a $20 check) and the Charity check to the insurance company. Well, apparently my insurance company cashed the check and cancelled my insurance without letting me know. The only reason I know my insurance was cancelled is because the Charity returned my $300 check and that’s when I realized my mistake. When I called my insurance, it was already cancelled 5 days prior and even though they cashed the $20 check, that wasn’t even made out to them, they refused to reinstate my policy. I had to make a whole new policy and set up for them to take the money directly out of my checking account. My question is, is this fair? Did I just get screwed out of my money?

They knew it was a mistake because they saw that the check they received was not made out to them. They had plenty of time to contact me and let me know that I sent the wrong check and to arrange payment. I didn’t even get a cancellation notice or anything. I feel like they did it on purpose so I would have to get a new policy. What do you guys think?

OK, the insurance company does NOT see your check. Payments get sent to a lockbox at a bank - a third party vendor, at their bank, deposits the checks and then reports the deposited amount to the insurance company.

Today is November 27th. So, your CANCELLATION date must have been Nov 20th or 22nd, at the LATEST. So they would have mailed a cancellation notice out to you, anywhere between the Oct 15th, and Nov. 10th, depending on your state law. And they don't have to be sure you get it, they only have to make an attempt to mail it.

Do you have an agent? If you're not a person who frequently pays late, an agent would have given you a courtesy call. If you DON'T have an agent, you're acting as your own agent. Yet one more reason to buy your insurance through an AGENT.

But yes, it's fair. You didn't get screwed. You got cancelled.

When you get your NEXT policy, be sure to sign up for EFT, so the money comes out of your account automatically, and you don't have to worry about mistakes like that again.

I'd be asking how they could cash a check made out to someone else. If it wasn't made out to them, most banks would have a very hard time accepting it.

If you haven't asked them about that, the time is now.

Also, usually there's some contact before straight cancellation, though if you have missed your payment they DO have the right to cancel.

The thing that's sitting not quite right in my head is your cashed cheque. Did they tell you they accepted a $20 payment? Or did someone else possibly get a hand on it?

Something's not quite right. I'd ask at a slightly higher level than the paeon that's paid to answer the call centre phone who won't have that level of knowledge of the rules and nusual circumstances-- they only see "non-payment: cancelled".

Something doesn't sound right. How did the insurance company cash a check not made out to them? And normally, there's a grace period on insurance policies before outright cancellation.

First, assuming this is large insurance company using a PO Box as a mailing address, they most likely did not "see" your check. Checks mailed to lock boxes are usually automatically deposited and may not be touched by a "real person" who works for the insurance company until the check itself has cleared.

Second, if payment in full was not received by the payment due date, they have every right to cancel your policy, mistake or not.

You have the right to be credited for the $20 check.

well as far as them cashing the check, i would be more upset at the bank that LET them cash it since it was not made out to them. they probably endorsed the back with a business stamp (it happens). as for younot getting a cancellation notice from them, thats illegal, so i guarantee they can produce one if push comes to shove. i don't know who you have your insurance with, but seeing how upset you are over this, and the fact you say they did not notify you of your policy canceling....I am wondering why you went back to them to get your insurance??

Though it is clear your intentions were good think about how many people do that to get an extension on paying their bills. They don't know you from anyone else and they have procedures to follow. It sucks but if they give you special treatment then they have to do it for everyone - even the people that are being dishonest.

Did you contact him??? It sounds like you have internet insurance, because at no time did you say "" I contacted my agent."
When you policy comes up for renewal, I suggest you see a local agent.This is why you need one.

try to talk to someone higher up in the company. if that doesn't work, call your state insurance department

It's definately a pain in the ****. You can go to your bank and request a copy of the check then call your insurance agent to see if they can help you with resolution.

Since today is only Nov 27th & you said your policy cancelled "5 days prior" to your call, I have to assume one of 2 things -
1 - your cancellation date was Nov 20th
or
2 - your renewal date was Nov 20th and you have a company like Progressive. They do not give the 10-30 day cancellation notice (depending on your state laws) on the renewal date (they would notify you on the renewal bill that this is the final notice & if payment is not received, the police expires with no further notice).
But, Progressive (at least the Progressive written by agents, I don't know about direct) will allow you to pay up to 30 days after the renewal date & they will issue your renewal with a lapse (starting the day AFTER the payment is received).
You didn't get screwed out of any money. The insurance company has to by law send you back any unused premium based on prorated (only charged for actual days covered) or short rate (penalty for cancelling before the policy term is up), some charge a straight cancellation fee (like Progressive which is $40).
If I were you, I would call an independent agent & change from the company you have. This is when agents can help you. I have had policies reinstated when the money was received after a cancellation date. I call the company & explain the situation & they agree (or not sometimes) to reinstate. If one of my insureds had the same situation, I would be on the phone to the company begging for reinstatement.
As others have said, the insurance companies don't see the checks, there is an automatic check scanning machine they use, they put in a stack of checks with the bill stubs and just scan the routing #s, account #s and amounts. Our agency still has an agency check (the insured paid cash) we sent to AIG that was never credited to the insured's policy. We sent them the front & back of the check & they denied ever cashing it. The company endorsement was smeared & was hard to read, they denied they had the money & we as an agency had to "eat" the premium & send another check.

just make the correct payment to the insurance company, and they should reinstate your policy.
