Yes, my son is on his stepfather's insurance and it's not a problem. Most employers allow you to make changes to your exsisting insurance after a marriage, even if it's not during open enrollment, so that you can add your new spouse and any new stepchildren. He may just have to show a copy of your marriage certificate and your son's birth certificate to his human resources department. And you usually have a time limit to add too, like maybe 30 or 60days. Congratulations by the way!

There are sometimes special stipulations for eligibility of stepchildren...for example, your husband's employer could require evidence that your son will be living with him and be claimed as a dependent for tax purposes on your husband's taxes.

It depends on how your husband's employer defines "eligible dependents." But generally, there are provisions for stepchildren to be added.

If you have custody or are responsibile for him finanically, then yes. You may need to wait until the company's open enrollment though. He needs to check with HR at his company.

Yes. However, there is a time limit. California allows only 30 days from date of marriage, adoption or birth to add dependents onto plans mid-year. If you are outside of that time-frame, you will need to wait until your open enrollment period.

Depending on your insurance company he should be able to do that but he may have to enroll in a family plan since your son is not biologically his. He may have to wait until an "open enrollment" period to do so. This is a time once a year when you can make changes to insurance plans. If you were married recently (less than 90 days) that is considered "a life changing event" and he could switch immediately. He should check with his insurance carrier for sure but hopefully this will give you an idea of what to expect.

Has he adopted your son? Are you divorced?

Usually, you can only put someone on insurance if you have what is called an "insurable risk". In this case, that means that he can only put the boy on the insurance if the husband is legally responsible for the boy's bills. If you are divorced, your ex is still probably still responsible and should have the boy on the ex's insurance. I said "usually" because some companies may allow this even though they don't have to.
