Your estate is liable for those student loans. If the life insurance pays your estate, that money will need to pay off your debts before your heirs can get any.

If the life insurance pays your son, or a trust to care for your son if he's a minor, than your estate doesn't GET the money - your son does. Life insurance pays who you tell them to pay. The government can't attach your son's money, to pay your debts - debts are not inheritable.

Your life insurance goes directly to the beneficiary(ies) that you name.

The government and creditors can not touch any life insurance policy. No one can touch that policy but the beneficiaries if you die. Just make sure you name a person and do not put your estate as beneficiary.

You might think about getting a living trust. It helps ensure that the money goes where you want it to. If you don't do that, then make sure your life insurance policy has a primary and contingent beneficiary.

A contingent beneficiary means in case something happens to the primary the money will go to the contingent beneficiary automatically.

If your child is a minor then the court could appoint a guardian and that person would get the money. So, if your son is still a minor, you might want to name an adult that you trust that would use the money to take care of your son.

I believe that student loans from the government are canceled if you die. Private student loans could demand repayment from your estate.

I'd double check this with a reliable source though.

If you name a beneficiary, the insruance benefit bypasses your estate and goes directly to the beneficiary and no one else can touch it (not even the governement).

If you do not have a benefiary designated, the insurance will go directly to your estate and all creditors (including the government) will have access to the money first, then it will go through probate (meaning the government will tax it) and then if there is anything left your family will have access to that (if you have a Will. If there isn't a Will, your estate might just get auctioned off and your family will have to buy your stuff back).

Way around this? Put a beneficiary on your life insurance policy (Make it your son and have a trustee [someone who is responsible enough and trustworthy enough to handle the money until your son is old enough]) and also have an up to date Will to make sure your estate doesn't get auctioned off to some Joe Blow rather than the people you care about. IF you have a very large estate, create a family trust instead of a Will (Will's are contestable in court and public record, so a family trust is a safer way to make sure your wishes are carried out, bu tif you don't have piles of money, it's not worth the time or money to set up)
