Over two years ago I was pulled over (in my now EX boyfriends) suv... he didnt have his new insurance card in the vehicle but the suv WAS insured. After this incident (just my luck) I broke up with him and never received anything in the mail regarding this incident. (I figured it was his car and his insurance and he had insurance so it shouldnt have been a big deal). Now two years+ later my license has been suspended because of this. I called his insurance that he had then and they said they would get back to me and see if they can help me resolve this issue...BECAUSE I havent spoken to him in 2+ years and I have no way of contacting him or anything for him to get this information for me. I know there are Hippa laws in NY state... but is there SOMETHING this insurance company can do to prove that he had insurance on the day I was pulled over so I can have the suspension lifted? After all... it is my license at stake not his... any advice would be great. Additional Details THE SUV WAS INSURED! I JUST DIDNT HAVE THE INSURANCE CARD IN THE CAR AT THE TIME... THERE WAS A POLICY!!! my ticket is for failure to show insurance card... not no insurance... |

The privacy law that applies in this case is the Gramm-Leach-Bliley Act not Hippa. That said your situation is pretty severe. The ticket was/is your responsibility not your ex-boyfriend's. Tickets issued to a driver when the police officer asks for your driver's license always follow and are the responsibility of the driver not the owner of the vehicle--I can assure you that that ticket had your name on it not your ex-boyfriend's. As a driver you are required to make sure that any vehicle you drive is insured in compliance with the financial responsibility laws in the applicable state whether the vehicle being driven is your car or not!
Failure to provide proof of insurance is a legitimate charge that you probably could have gotten removed if you had followed up and provided the proof of insurance at the time.
My suggestions for trying to resolve the problem after the fact--
Get back to the insurance company (and please be nice btw) and ask them if they are still working on this, do they believe they can resolve it, if so how long will it take? If they say they can, be patient. If they say they can't because of compliance with privacy laws, then ask them if they can provide the proof of insurance on the vehicle directly to someone at the court or at DMV (i.e. that they do not have to give you a copy at all). If they agree with this, speak with someone at the Courthouse and/or DMV who is in a supervisory position and ask them to help you with this, i.e. to receive the letter via fax or e-mail and to see if this is sufficient to get your situation resolved. If they agree, get all their contact information and give it to your contact at the insurance company & ask them how long it will take for them to send the necessary information/documentation. Depending on their answer make sure you follow up with the contact at the Courthouse and DMV and that the situation gets cleared--do not drop the ball on this and assume its done! Make sure it is cleared and ask for a clearance letter--keep the letter for years (no less than 10 and maybe perpetually because you never know if it will come up again!).
If the Insurance Company refuses to assist you, call the Insurance Commissioner for suggestions or find your ex-boyfriend and beg him!
A couple of years ago one of my clients went through a similar situation. I was able to sweet talk a clerk at the court to speak to a judge and get the conviction for driving without proof of insurance withdrawn. The lesson with that is that it is a conviction, it is/was legitimate and only by literally throwing yourself on the mercy of the court, the DMV and that insurance company can you possibly resolve this.
If the DMV or the Court does not accept this, then your only option will be to pay the fine, the reinstatement charge and ask if you can file an SR-22 (a Certificate of Financial Responsibility--it may be called something different in NY) so that you can keep your license.

"Hippa" laws have nothing to do with auto insurance. It is the driver who gets the ticket, not the vehicle owner. Were you issued a ticket at the time? That's when you should have dealt with it. |

I don't believe HIPAA has anything to do with auto insurance. It is the Health Insurance Portability and Accountability Act, relating to health insurance. If the auto Insurance people said they would try to get back in touch with you then they probably will, your only other recourse would be to track down the ex-boyfriend and hope he will be understanding and help you out. If you had auto insurance at the time perhaps you could show proof of your insurance.
Was the ticket just for failure to show proof of insurance. If the ticket was issued to you, ultimately it was your responsibility to take care of it. |

There is nothing you can do. Your actual violation isn't driving uninsured - it's driving without proof of insurance in hand. Which, you didn't have. So the TICKET is valid.
Likely, you didn't PAY the ticket, which was VALID, and then your license got suspended for not paying the ticket.
You're not going to get this suspension lifted, and HIS insurance company isn't going to give YOU proof of HIS insurance. Even if they did, it wouldn't nullify the ticket. So, you have to pay the ticket & late fees, pay the suspension fees, turn in your license, wait out the suspension, and THEN you can get your license back. Sorry.
You CANNOT ignore tickets when you get them. You just can't. |
