Michelle | Can the waiting period for group health insurance be negotiated at time of hire? |
My husband may be starting a new job and I wondered if anyone has ever been able to get their new ER or HR to waive or at least shorten the waiting period? I don't want to have to elect COBRA from previous ER and I know I can't go more than 63 days w/o coverage to provide for continuity so I am wondering if this is ever negotiable. I guess it would require "fudging" the hire date on the enrollment form, right? Any HR people out there who can enlighten. Also, I live in NC. |

Usually no.
The waiting period is part of the insurance contract between the company and the insurance company.
If they change the date of hire in the hiring papers, it is fraud and insurance companies are really good (or lucky) in uncovering fraud.
So, the only real option would be to negotiate for the company to pay all, or part of COBRA.
Don't know where you live, or what specialty your husband has, but jobs aren't easy to come by, there are hundreds of applicants for most openings, and the company may not negotiate at all.
But, you can always try.

And its not usually, its no. Unless you want to break several laws.
Your only option is to negotiate COBRA costs into his offer letter. |

Usually not. Most employers have some type of waiting period, and to make an exception would be discrimination. They can do it for different employee "classes", hourly vs salary or management only.
But, also realize that any waiting period from a new employer, does NOT count towards the 63 day gap. For example.. I could start a new job that has a 90 day wait for health benefits, not elect COBRA, and still not have any credible break in coverage. Now, I'd be without health insurance, but when my new plan kicked in, I'd be fully covered under the new plan. |

Usually it's "the deal" beween the insurance company and the employer, when the policy is first set up. I imagine it could be negotiable, theoretically, but for large groups it's not going to happen.
You can't lie (aka, fudge) because the insurance audit will go from PAYROLL reports. |
