I was fired from my job, applied for unemployment and was initially turned down. Long story short, employer said I disregarded company policy, but what they accused me of was untrue. I filed an appeal, giving my explanation of what happened, and I won the appeal. I received unemployment for 9 weeks.
Just this week I started a new (much better) job, and I will be telling them that when I file my weekly claim for this past week, so I won't be getting any more unemployment. But yesterday I received a notice that the employer has filed an appeal and they are scheduling a phone hearing.
My question is, what happens if they win their appeal? Does this mean I'll have to pay back the nine weeks of unemployment I received? Or does it just mean I don't get any more money? That's fine, I don't need it anymore. But I can't pay back over $3000. I used that money to pay my rent, feed my 4 children, and keep the power on while I found another job. I'm scared. Does anyone know how this works? |

Yes, they can require you to pay it back if you lose the appeal. Contact your state employment dept. for info on how that process would work. |

Here in PA if they find in their eyes that you received the unemployment when you shouldn't have, then yes they can make you pay it back. However, they don't make you do it as a lump sum. If in this phone hearing they find in you previous employer's favor, perhaps you can appeal that as well. |

First, both you and your employer have done everything that they are entitled to in this process. If your employer wins the appeal, you can appeal that too. If in the end, they win, you will be obligated to pay back the benefits you were paid. See the link below, pg 20,21.

you may have to pay it back plus interest but when your old company finds out you are working, they will probably drop the appeal since they will only be charged with 9 weeks instead of a possible 26 weeks |

I doubt if you have to pay it back my husband lost his job after a serious car accident and he had to go through an appeal process to get his wages too but once he found another job he told them about it and they still let him receive two more checks before they stoped it. |
