Whether or not you qualify for workers compensation benefits is determined by the workers' compensation laws in your state. First I would urge you to contact the workers compensation authority in your state and request a pamphlet on an injured employee's rights. Second, contact your employer's workers compensation carrier directly and request the same. If your employer was/is self insured write a letter to human resources requesting a written explanation as to why benefits have been denied. this letter should be sent certified mail return receipt requested. In most states you, your employer and the treating doctor are required to complete forms and submit them to your employer's workers compensation carrier. Typically, if you loose three or more days of work as the result of your injury you are entitled to TD and or PD. ( Temporary Disability benefits or Permanent Disability benefits). These benefits continue until you are released to go back to work by the treating doctor as limited or full duty. Your status as a college student should in no way effect your eligibility for workers compensation benefits. If all else fails hire a good workers compensation attorney. |

Yes, you can collect it. Since you are not doing the same type of work in school as you are on the job and your head injury is in no way jeoparidized, you can collect safely. If they are giving you hassles about it, contest it. You might have to call your local department of labor on that one. In fact, I would highly recommend that. First thing tomorrow call them. They will give you all the facts that you need and will also represent you if your jobs insurance company gives you hassles. Good luck to you and I hope you feel better soon. |

....i belive you can, atleast to pay the medical bills, fact is you were hurt on the job, it has nothing to do with your education. as long as you still have the ability to listen, type, write, and think, you can go to school. The same does not apply for your job, it may require things like lifting heavy loads, or being on your feet for long periods of time, or walking for some distance, and many other straining things that you would not have to do to attend class... ie sit down, raise your hand, speak....if all else fails, drop a class so that you are just under the 12 credit full term criteria so they cant say you are attending full time |

Your ability to collect on workers' compensation (not workMANs comp....by the way) has to do with how you were hurt and not your educational status.
If you were a worker for which they had to pay a work comp insurance premium (which they probably did), then the insurer must pay you if you are hurt regardless of whether or not you were a full time student.
With one exception....you cannot try to make a claim, claiming you are on permanent total disability (which is supposed to pay if you can't do any work at all ever) AND be a full time student.
If you are fully and permanently disabled and you want a PTD claim, than that's it. No more work and no schooling. |

Well, if you can attend school full time, you can work full time, so I can see where they are coming from.
You can only collect lost wages from workers comp, if your injury is keeping you from working. It doesn't pay you to go to school. Sorry. |
