No as there would be a case of double indemnity . One accident one payout is the UK method even if the insurrers got together and divied up the cost |

If you mean can you file for worker's compensation and also sue the company, the answer is no.
Worker's compensation is supposed to protect workers by providing immediate coverage for medical bills and lost wages, while preventing employees from dragging the employer into court.
In some states there are exceptions for "intentional" acts of the employer. |

Depends on the claim, where you are located, and the employers liability situation. In states with mandatory workers compensation, if you've collected workers comp for the incident, you cannot sue for employers liability. You CAN personally sue the individual who, for example, ran over your foot, but the company's insurance doesn't step in and cover them. The company is fully protected - that's the "deal" with workers comp. |
