Cookie On My Mind | Can your company FORCE you to take their health insurance? |
My company states that you cannot opt out of their health insurance (20% premium) unless you have proof of other health insurance. Some employees are not married or have spouses who cannot get health insurance, and they are wanting to opt out because they need more money - but the company is not allowing them. Is that legal? (I'm in NH if that matters - I tried looking it up, but haven't found the answer) Thanks for any insight! |

Yes, it is legal.
The fact is with group policies the insurance company has a requirement that everyone employed there be on the plan unless they have other insurance. This keeps the premium down for the group as a whole because of the rule of numbers. If they allow people to opt out only the sickest employees will keep the policy, which would either cause the premiums to skyrocket or the insurance company to decide not to do business with your company. In order for your company to keep the insurance for everyone that wants it they require everyone to have the insurance. |

Yes. They do it to protect them in case you are injured. Also, they make you take their insurance so that the company can get cheaper rates due to the large number of enrollees they have. |

In Indiana, you can opt out if you have to contribute. If the employer pays all the premium, you cannot opt out. I assume by (20% premium) you mean you have to pay 20% of the total monthly premium. I don't know how you can be forced to purchase it. Check with your state's insurance department. |

I'm gonna go out on a limb and say that you have to take what they're offering you or get insurance somewhere. Given that you live in liberal NH, I'm sure they have a 'full coverage' law that they were so proud of b/c everyone in the state is covered, blah blah blah.
Call the state representative to NH in you district, they'll be able to advise you further. |

to the best of my knowledge, no company in the United States can force you to take their insurance. You don't need to provide them with proof that you have other insurance either. It would be a different case if the insurance was free, and was something that was offered to employees, but this doesn't sound like the case. I'm sorry, i don't have any more information than this, but it does sound very frustrating. Good luck, i hope you get things figured out. |

Nobody can force you to do anything you do not want to do...I have a paralegal background and also had my NYS license to sell accident and health insurance..If you want to do something different, It may cost more but there are many other options out there.. For instance, get yourself a whole life ins policy. As it builds up you have money you can take as a loan but you don't have to pay back, but they can charge you like $15.00 if you don't///State Farm also has many options of retirement, hospitilization, retirement, all which collect interests, they can describe them better....There should not be a problem, but read the small print, they may have time allotments before you can sign out...HOpe that helps some |
