Cancel my Health Insurance?
Can my previous employer deny/cancel my health insurance if I was fired? If they dont offer COBRA support can I seek legal help into this?

Your previous employer will cancel your health insurance whether you quit or are fired. They will not continue coverage for ex-employees.

After a policy is canceled, employers who fall under COBRA laws offer eligible employees the opportunity to elect COBRA insurance. In a COBRA policy, the employee pays the full premium + an administrative fee. The employer does not contribute anything to the expenses for the ex-employee. That's why COBRA coverage is so expensive - it could easily run you $500 or more a month just for premiums, then you'd still have your deductibles/copays/coinsurance on top of that.

If you're not eligible for COBRA, then your ex-employer has no further obligation towards your health insurance.

Since you're young and healthy, your best bet is to purchase your own private policy. You'll get a better deal that way, even if you are eligible for COBRA. COBRA really only helps people who are already sick, pregnant, or otherwise couldn't get coverage on their own. Otherwise, its not a very affordable option.

If you are healthy, then it does not matter. At age 22, you can get private health insurance a whole lot cheaper that cobra will offer. Cobra is only good for people who are not healthy and need guaranteed coverage.

Depends on the reason you were fired as says the first answer. If they just didn't like you then they HAVE to offer it to you (assuming they fall under laws that obligate them to offer COBRA).

But, if you stole from the company, destroyed property, or anything else that would fall under 'gross misconduct' then you're out of luck.

BTW...I'm assuming you need the COBRA and aren't healthy enough to get it on your own.

They have to offer COBRA if you were fired for anything besides gross midsconduct.

Not only can they, they have to cancel your insurance because you are no longer an employee. An individual policy it the best way to go because it's less expensive, and you own the policy. As long as you pay the premiums you cannot be canceled or singled out for a rate increase. Call a local broker to see what's available where you live.

Yes, the day after you're fired, if they are NOT cobra eligible, they can cancel your health insurance.

Think about it. They are NOT required to maintain benefits for all their ex employees, not for forever, not even until the end of the month.

Best you can do, is talk to a local agent, and try to get a private policy.
