hipzncurvz | Cant let it go, should I sue? |
My wedding day was on 9/27/08. I designed and set up the church and reception the exact way I had it in my mind since our engagement. The men, the colors , the dresses, flowers, my hair and everything. It was all hands on and me doing it all. Well, when we were in the holding room before they called us out at the banquet hall, I noticed there werent any balloon centerpieces that I ordered and paid for a month before in full. I sent one of my girls to double check and the look on her face said it all. SHE NEVER SHOWED UP TO SET THEM UP... needless to say, I freaked out, crying and screaming. Even though people said they didnt notice, I was soo embarrassed. I felt the need to go to every table and apologize personally. It just looked so stupid without the centerpieces...
we were leaving the following morning for st thomas but when i got home from reception, before i called and blasted the lady, i checked and doubled checked our emails and invoice to make sure I didnt make a mistake. It was about 7pm, when i called and emailed her. I got a call about an hour later and all she said was "i am sorry, i dont know what happened. I just forgot.". I couldnt even speak. I started crying and my MOH took the call. She refunded us 215.00 right then, to my husbands card but I paid her 216.00... then when i got back from our honeymoon, i saw two more emails confirming her transcation to credit his card, but she also tried to down play the whole thing. I will never get that day back and EVERYTHING was to the T's except my centerpieces. I feel that she needs to see the seriousness is this.. sorry so long, any opinions welcomed. Additional Details For you information Kate M. In my state, u can file for punitive damages up to 3,000 for breech of a written and verbal contract. All my plans were finalized and came thru except this lady. Grow up. this was an adult question and obviously you cant provide an adult answer. |

I am sorry you went through this, but you got your money back. You can't sue for something like this. Well, you can, but it is not worth the time and battle, plus you would very most likely lose.
File a complaint with the BBB, maybe your state's consumer affairs department, and other sites to make others aware of your disappointment. |

You have the option to sue, but in a court of law your wedding day doesn't matter. The only issues are services paid for and services rendered. Since you paid for a service and they refunded all but one dollar, your claim in court will probably be ignored. Sorry to be so blunt, I understand the ramifications of your wedding day. I truly feel for you and how what you wanted to happen didn't. |

Since she refunded your money, most states consider the matter closed. If you filed a suit, the judge would throw it out summarily without going to court because she refunded your money. You don't have a cause of action for punitive damages either, since you didn't suffer any consequential damages (money loss) from the breech.
A courtroom's purpose is to remove emotion, and only tackle the money problems.
Having said all that, REALLY spread the word about her extreme insensitivity and total disregard.

That is awful, I know that your wedding day is really important and you obviously put a lot of time and effort into your day. It sounds like the church and the whole thing was beautiful.
But you were hands on and I know it must have been hard to enjoy your day to the fullest without everything being just the way you planned and you are right you can't get that back.
Maybe what you can do is call the lady back tell her you appreciate her being prompt in refunding the money though you could point out the 1.00 she forgot and let her know that there really is nothing she could ever do to make up for not doing what she was paid to do. Let her know also that you don't appreciate that she down played the situation. I kind of get the feeling that it wasn't that she forgot it is that she mad you feel as though she didn't think it was that important. Let her know that you will not be referring anyone else to her.
Then let it go, suing her would only make that part of your wedding day even worse as you drag out the bitterness of the situation. Just move on, remember the things that did go right not the one thing that didn't. Good luck. |

Sorry to hear about what happened. But I don't think you should sue. NO amount of money is going to change what happened that day. And it was your wedding. The most beautiful day of your life. Don't let it be ruined by missing centerpieces. |

Wow. I'm finding it hard to believe that a grown woman had a temper tantrum - tears and all - over BALLOONS.
Honey, the wedding is just one day. It's just a PARTY. The whole point, is the MARRIAGE, which is going to keep going. Life is too short to waste that kind of energy getting vengance on people for accidental mistakes.
Unless she deliberately didn't bring the balloons just to "spoil" your day, you're not going to get punitive damages. You have to prove INTENT to be malicious, not just "oops I forgot" or "oops my kid split his head open and I was in the emergency room".
It's a PARTY for goodness sake. I'm married, I had a lovely wedding, that didn't go perfectly, and I really don't see the seriousness of your complaint. I'd not waste any more energy on this, since you got your refund. |

Oh my god, you can't sue for that you idiot.
It's your own fault for not making sure she was prepared, it's called finalising last minute plans, just cry about the dollar you didn't get back and leave it alone. |
