Car Accident Lawsuit?
ok, i had an accident about a year ago and i already told my insurance about it. so my question is, am i responsible to get my own lawyer when the plaintiff filed a lawsuit on me? or is it the insurance company's problem??? cuz i got a summon from a court and should i forward this to my insurance company?? i just got infuriated when a summon arrived this morning. theyre asking for a lot of compensations, as if the plaintiff had collided with a ten wheeler!!! theyre askin for disabilities, hospital fees and so on.... jesusss! i only had a dent not bigger than a penny and few scratches in my front bumper!!!! if you look at my car 20 ft away ull never even see a thing!!! you gotta be kiddin me! i need opinions... thanks in advance

its not a big collision... i mean if my front bumper didnt even bend then why would they even get serious injury??? im on a stop sign about to merge on a highway and im completely stopped... i was looking at the oncomming traffic from my left side i thought the car in front of me already passed through, so i hit him in the back. Btw i hit them from a complete stop to about 5 mph! imagine that! (sigh)

The other answerers had some great advice. Timely notification of your insurer is really important because of the 30 days response requirement! Call and fax, or drop a copy of it by (keep a copy for yourself!).

My best advice to you is to relax. This is why you HAVE insurance. They will defend you, and it likely isn't going to cost you any more in increased premiums than the accident has already caused. Most likely it will be settled and never get to court. The most you will likely have to do is give a deposition, and though that's possible it's not likely either.

The adjustors and lawyers are very familiar with people padding claims, and they're very good at their jobs. It's also important for you to know that people CAN have permanent injuries from low-speed crashes, ESPECIALLY if they're older. I've had it happen to myself (though I didn't sue) otherwise I'd likely not believe it either.

I know it feels like an injustice, but take comfort that it really can't hurt you. Even if they were not seriously injured and yet do collect from your insurance I like to think that karma sucks for people who don't do the right thing. What goes around, comes around.

First of all, how much damage did the other guy have? Their Injury amount will depend on their damages and yours.

This is your insurance companys problem. Call them ASAP and give them the summons and all the paperwork. They will take care of everything for you.

How did the accident happen? It really doesn't matter, I was just wondering. It is really the amount of damage to the other car that makes a difference.

Other poster is wrong. Your insurance covers defending you in a lawsuit.

+You still didn't say how badly damaged the other car was. If it wasn't that damaged, then the insurance company will not be paying them that much. Just give the summons and court papers to the insurance company and they will handle everything.

Your insurance policy will provide you with a defense for the loss. You need to forward summons to them ASAP as they have a time limit to respond to the suit. If you wait too long they could deny defense (though I have never actually seen this happen)

Lawsuits are pretty outrageous. That's not unusual.

Call you insurance company immediately.

They will hire a lawyer to defend you (and they pay the bill).

However, they need to get that lawsuit from you asap.

When you are served, a clock starts running. Your lawyer has to get an answer on file with in 30 days of when you got that suit. If you don't it's an automatic "you lose" (Default Judgment).

When you contact your insurance company, they will get the suit papers to a defense attorney and the they attorney will get an answer of file. The more time they have the better.

Call your insurance adjuster first thing tomorrow morning. The adjuster will need to know when you got the suit papers (date/time) and how (process server or certified mail). Then they will make arrangements with you to get the papers to them.

If the other guy is claiming a bunch of injuries from a very minor impact.....that's exactly why the law suit was filed. Your company may not be agreeing to pay for all the cr@p that the guy wants.

It happens.

Your insurance company will hire a good lawyer that specializes in this type of case.
