Car Crash Help?
I was in a taxi this morning and he crashed into another car I was thrown from the back seat. The taxi driver was very rude with me and the lady from the other car involved. Does anyone know if I can put a claim in against him or will it be classed as my fault for not wearing a seat belt?

I agree it was silly not wearing my seat belt but police did say today you dont have to wear one in a taxi

If the taxi had rear seat belts, and he did not advise you to fit your seat belt yes, and you did not except this he should have refused to take you unless your fitted the seat belt, hope this helps

If this is a UK based question, then for rear passengers of cars and goods vehicles "Seat belt must be worn if available".

The crash is not your fault. Whether adult back seat passengers (or only children and front seat passengers) must wear seat belts varies from place to place. Repost the question with the location (country and state) of the accident.

If the taxicab driver was at fault in this accident, you have every right to file a claim for any injuries that you suffered as a result of the accident. Your claim would be for medical expenses, if you miss work due to the injury--loss of income and or pain and suffering. The fact that you did not have a seat belt does not invalidate your claim.

I would suggest that you secure the services of a good attorney. Try to get someone through a referral from a friend--don't just get one that advertises.

Any claim would have to be under the personal injury rules - and frankly if you have only suffered a bit of abuse [rather than physical injury or loss of something such as earnings] then you have no claim.

Any claim that you might make, would probably be discounted by the insurer if [for example] seat belts were provided but not worn.

Your chances of success seem to be quite slim, but if the taxi was part of a larger company then try making a written complaint to the registered trading address - if you got the licence number off the back of the taxi then you can trace them through the local authority.

Why would you file a claim against him? For being rude? The only claim you possibly would have would be an injury claim....if you were truly injured. If you didn't have to go to the hospital, and you feel like you'll be alright, I would just let it go. The taxi's insurance could throw the seatbelt thing back in your face.

You can try to claim from his insurer but if he knows and informs them you did not have a seat belt on then its highly unlikely they will pay out

Taxi passengers do have to wear a seat belt in a taxi.

If you have auto insurance I would consider placing a claim under your own policy first in order to expedite payment for your medical bills. If not then you can file a claim. Not having a seat belt on will not invalidate your claim (you didn't cause the accident), however the amount recoverable will be reduced because your were not wearing a seat belt. You didn't cause the injuries to yourself, however you did make them worse by not having a seat belt on.
