I recently got into a car accident which was my fault because i fell asleep behind the wheel. My Jag got totaled and the other car was damaged a lot too. I got a call today saying that I am being charged $13,500 in full, for the other cars damage. I do not have that kind of money right now...is there any type of loan that i can take out to cover that sum...is there anyway other advice on what i can do...HELP!! |

If you have liability coverage and the limits are sufficient to handle the other person's damage - then contact your insurance company and report the claim to them.
If you do not have insurance or had insurance and your liability limits are not sufficient to pay for the other person's damage - then you will be held personally responsible.
You can call up the other persons insurance company and set up an interest free payment plan with them. As long as you make your payments on time - every month- they will not take further legal action against you.
Or you can call and see if they will accept a lesser lump sum payment. Many companies would rather get some now and not have to fool with getting payments from you. You can call and offer to settle with them for 50% (a lump sum payment) and they may go for it. I would expect them to take at least 30% off in exchange for a lump sum payment.
I don't recommend you ignore them. They can suspend your drivers license, turn you over to collects and/or sue you. |

This is why its so important to have insurance!! Plus, its illegal not too.
If you have insurance, then you simply have them contact your insurance company and file a claim. The liability portion will cover them. if you dont, then you have to pay out of your own pocket, or they will probably sue you. |

Your insurance should cover it, that is if you have insurance. If you don't have insurance then you'll have to pay out of pocket for the other car. Unless you live in a wonderful state like California where there are so many illegals without insurance that you have to pay an extra fee every month to cover uninsured motorists! I love it when I get that charge on my bill. Damn mexicans, and that's what they are, Mexicans.
**Oh, and I forgot to mention - it is a crime to drive without insurance - so if this all applies to you I hope you go to jail.
Should have maybe bought a cheaper car so you could afford insurance. |

Any personal loan, will depend on your personal finances. Go talk to your bank. Or take out a second mortgage on your house.
Otherwise, you'll have to set up a payment plan. They'll likely want it paid in full within six months, or they will just go ahead and garnish your wages.
I guess you were either uninsured? Otherwise your insurance would have paid for the other car. |

I take it from your description that you did not have insurance at the time since you are being expected to pay for the damages, or else your insurance would be paying for the damages.
So you want advice? As for the sum the best you can do is go to the bank and see if they will extend a personal line of credit for the amount (although with the current credit crisis you better have fantastic credit or collateral). Beyond that I would speak with a priest or a therapist and try and get your life back in order (no insurance + asleep at the wheel = moron). |
