Car fender bender -insurance low balling payment, how to get more money from the insurance company?
Had a fender bender accident and the other driver was charged, the insurance adjuster said the damage is $1500.00 and gave check (not yet cashed). Took car to repair shop (from the insurance approved list) the estimates were $2000.00 and $2800.00. How and what can be done to get the insurance to pay up more, so I can decide later when and where to get the car repaired? Thanks

The adjuster is not going to just give you more money b/c a shop says so.

Pick which shop you want to have to the repair. You can use any shop you chose.

When the shop gets to repairing your car - if the damage exceeds the amount of the insurance company estimate, then the shop will call the adjuster. The adjuster will inspect the torn down car and approve a supplement as appropriate.
The check for the supplemental repairs will be issued and mailed to the shop. This check is in addition to the one you already have.

If you want to pocket the money- you can do that. But you get to pocket the amount of the adjusters estimate.

With out seeing the estimates - we can't tell you why one is higher than the other. But that does not mean that the adjusters estimate is wrong or not valid. A 500 difference can easily be a parts price difference or labor rate difference.

Don't cash the insurance co cheque.

Get 3 independent repair shop quotes, in writting, for the repairs, then call your insurance broker, and ask for a meeting, to sort this out.

Put it this way....Tell the insurance co that they can have it repaired, at their expense, at their shop of choice, but you won't accept the current payment. Remind them that each state has it's own inusrance regulatory board and they will be your next stop, if this isn't resolved in quck order.

Send him the estimates and the cheque back and ask him to provide you with a copy of his estimate for comparison. Is he overlooking something or is the body shop trying to overcharge you for work that is not related to the accident?
Don't take a cash settlement ever! If there is an 'hidden' damage ie damage that is related to the accident but cannot be seen on just an 'eyeball' estimate you are stuck paying for it yourself because you have already settled the claim. Get your car repaired and let the shop bill the insurance company directly. That way you are protected and are sure ALL damage is repaired.

What is your deductible? That comes off the top. Call the insurer again and give them the written repair estimate.

You talk to your agent.

Who's insurance is it, that you think is lowballing? If it's the other guy's, you need to have the body shop talk to the adjuster, and work something out. OR, maybe your body shop is charging a lot more in labor than the "going rate".

If it's YOUR insurance, you have to remember that they take out the deductible, as well!

Regardless of who the insurance company is, the body shop can ALWAYS file for "supplemental damages" if they find something else wrong. BUT, the way you're wording this, makes it look like you might not get the damage fixed, anyway. In which case, you're going to get lowballed. The way to get the full cost of repair, is, obviously, to repair.

In ANY case, YOUR AGENT should be working this for you.

You can't. They know you aren't going to get it fixed so you won't get any more money. Under the law, you can take the car to any repair shop of your choosing and if there is a difference, they contact the adjuster and the difference is made directly to the auto shop.

That is the way it works.
