Car loan my car is totaled?

Do you have GAP insurance? If so it will pay off any difference between value of car and value of loan. You make it seem as though the care is worth more than the loan however. So your insurance will cover it. You should receive a check for the difference.

if you still have an outstanding loan, then most lenders require that you have insurance, which would pay off the loan. Yes, you can go to small claims court, and probably win a judgment.

you could go to SCC, but if you win and the judge orders im to pay the 1500 dollars and he has no money you r not going to seet eh money. if you still have an outstanding loan against your car then you bank should have also made you buy collision insurence and also liability. the collision should cover your danage through your insurence company.

Since you still had a loan on it, you still had collision coverage on it (I am assuming the loan would require it). You submit the claim to your insurance, your company will determine the actual cash value, they will subtract your deductible, they will send a check to your lienholder for the $1700 owed and send you the difference. They will then attempt to collect from the at fault party. He will have to pay them back unless he is completely judgement proof (no assets, no bank account, no job, disabled, etc). The insurance company will do all the legwork for you, you will not have to take him to small claims court because they have all the resources needed to collect the money back from him, if possible. They will also collect your deductible back.

You will need to submit a claim to your auto insurance company. If you had a loan on the vehicle I know you have to have collision coverage. What will happen is the insurance will pay you an amount of what they think the vehicle is worth. Then if you agree on the amount they will send you some documents, and a check. You will have to sign the documents and send those back. The check will be in your name and alos the bank's name. What you will do from there is take the check to the bank, and if there is an amount left over then you will get the reminding amount. See if you have GAP insurance. If you have that, and the insurance company only pays you like 1,000, then GAP insurance will pay for the rest.

Now don't think that the drunk driver is getting away with murder, because he ain't. Your insurance company will go after him for the amount that they paid.

Now you can always go after him in small claims court. If he doesn't have the money, then his wages will be probably be garnished.

If I were you I would contact your insurance company or a lawyer, and see what they think. I know that with some attorneys the first 15 minutes are free.

I hope that I was some help to you, and I am sorry for what happened to you. Some people just don't think before they do.

Regardless if you owe on it or not you can take the guy to cmall claims court for the value of the car. Are you going to get the money? Not likely but it is worth a try.

I am assuming you were not carrying collision on the vehicle (as required by your contract) by the way your question is worded....you will have to pay the 1700 even if you can't get it back from the other guy.

You can go after him but even if you win in court that doesn't mean you'll ever actually collect anything. I hope you had uninsured motorist coverage.

Sure you can, but you won't win. He's not on the hook for your loan, or the loan balance, or your high interest rates, or negative equity from a prior vehicle.

He's only on the hook for the actual cash value of your car. Period.

So if you already got paid that from your insurance company, that's the end of it - you've automatically transferred your right to sue him, over to them. And they'll try. But if you didn't have collision, go ahead and sue him for the actual cash value. Good luck trying to get the money, though, even after you get the judgement.

Depending on the state you live in and your own policy, you could sue the other driver for the entire KBB value of the car, not just the amount you owe to the finance company.

Obviously this would be reduced by any money you receive from your insurance company.

Unless you are in a "no fault" state, then 100% of the payout is based on your own policy and you are very limited as to the amount you can sue the other driver for.
