He needs to take the summons & complaint to Allstate immediately so that they can respond (I think there is a 20 day limit on the summons & complaint to answer it). They were the insurer at the time of the accident. I hope he reported it to them at the time so they could investigate the accident & determine fault. If he did not & this is the first notification, it could jeopardize the claim. Did the other party claim damages to his vehicle? Did Allstate pay for the damages? |

The insurance company of record at the time of loss is the insurance company that handles the claim, and that is AllState. It is chintzy to change companies just after an accident by the way. You expect the company to stand by you if needed, but show no loyalty afterward? In my opinion it is dirty pool to switch companies in the first year after any claim or possible claim. But, it is legal. |
