Claiming Independent = No health insurance?
Hi!

I'm 22 years old and a full-time student. I'm currently receiving health insurance from Cigna through United Space Alliance under my Dad. I'd like to file my taxes as an independent so I can get a bigger return. I support myself, I don't think my parent's should claim me this time around.

If I ask them not to claim me as a dependent will I lose my father's health insurance? Or are the two "dependent" issues separate entities?

Thanks a bunch!

You have received very inaccurate answers so far.

Is it possible that you need to be a dependent for tax purposes to stay on your Dad's health insurance? Yes, if that is how eligibility is defined on your Dad's benefit plan.

The only way you can know the correct answer is to have your Dad confirm with his benefit administrator/Human Resources department to see how his specific benefit plan is established.

As for the other answerers...you should avoid giving responses to someone pretending your answer to be "fact," if you have no idea what you're talking about. A person could be harmed by your ignorance.

Tax information can be verified through Dependent Eligibility Audits. (I know - I've worked on such audits in the past, and I have had to remove dependents from insurance plans when they didn't meet eligibility criteria.)

But don't just take my word for it...here are links to several news articles which discuss what happens in a dependent eligibility audit and what kind of information can be requested:

http://www.businessweek.com/magazine/content/07_48/b4060082.htm?campaign_id=rss_topStories

(Also note the comments attached to the Business Week article from an upset man who's sons were dropped from his insurance because he didn't claim them on his taxes.)

Article from the Wall Street Journal (note below the box graphic which states that you can and likely will be required to provide copy of tax return, when dependents are being audited): http://online.wsj.com/article/SB118946144721423027.html?mod=googlenews_wsj

Bottom line...the only way you can know whether YOU need to be on your dad's tax return is to have your dad confirm with his employer. Anyone who tells you that being a dependent for tax purposes is "always irrelevant" to health insurance has no clue what they are talking about.

Separate issues.

They are completely different issues. You can be a dependent on health insurance but not an official dependent for IRS purposes. I did the same thing.

You have to ask your father. It depends on the terms of his specific health plan.

Health insurance companies have no access to tax records (that is a good thing).

So, you can be "not a dependent" for tax reasons, and be a dependent for insurance reasons. I'm sure the insurance contract just states something like "under 19, or under 23 and a full time student." (It might be good to check)

It is not really a choice between you and your dad whether he or your claim your personal exemption. Either you provided over 50% of your support (including household support if you live at home) or you didn't.

Whether you ask them not to claim you has no effect on whether you are allowed to claim yourself.

If it is legal for your parents to claim you on their taxes, then it is illegal for you to claim yourself. Whether or not your parents do claim you makes absolutely no difference. The law is that you are permitted to claim yourself ONLY if it is illegal for your parents to claim you, not if they simply choose not to claim you.

Well, if you're not a dependent, why are you using dad's health insurance?

Many, many employers have set their health plans up, to now require health insurance dependents to ALSO be tax dependents. So no one here knows, but it's highly possible that if you're not a dependent on dad's taxes, you will get dropped off his health insurance.

You may want to verify the age at which your father's insurance will drop you and prepare for providing your own insurance. If you are in college, you may want to check out health insurance programs that are written through your school. United Healthcare has a plan available at many US schools. These student injury and illness plans provide wide ranging coverage and are designed to be affordable for college students. To check if your school is participating, go to www.UHCSR.com and enter your school name in the search box. You might also be interested in joining the American College Student Association (ACSA), a national organization for college students. They have lots of member benefits, including student health insurance. Their membership fee is affordable.
