AES | Cleaning company refusing to pay out for breakages? |
Hi - we, and some of our Friends, use a cleaning company. They have recently written saying they will not pay for any breakages their staff may incur. Obviously we can change companies but Is this legal? |

This is ridiculous. In the UK, if someone damages someone else's property, they are legally required to pay for its replacement (unless the wronged person waives their rights). Ideally, the company should have public liability insurance to cover it, if not then they should pay the compensations themselves.
Having re-read the question, it seems that in this case the cleaning company is asking your friends to waive their legal rights to compensation if any breakages are incurred by their staff. So, I suggest your friends change to a different cleaning company.
Sorry for this third edit; I've just thought of yet another thing to add: If your friends do decide to stay with this particular cleaning company, then it means that if the staff cause any breakages, your friends would have to claim on their own home contents insurance (probably under the Accidental Damage section). This would mean they would lose their no claims discount for their home insurance, and their premium might increase in the following years. So I strongly recommend they move to a different cleaning company. |

Yes it's legal. They are simply informing you of the terms and conditions under which they will carry out work for you. If you don't accept the new terms, then you are able to inform that you no longer require their service. |

That is absurd! If you have anything that they break, of course they are liable. Terminate their contract immediately, and go to the Yellow Pages for another firm. Establish your view and ensure their compliance.

Yes - it is legal.
This could have been their position all along - and something has happened that has caused them to put this in writing to you. Frequently you see a sign posted in a garage that says "Not Responsible for Items In Customer's Car". A business has the right to determine under what terms they offer the service. Of course, the law prevents discrimination on the basis of race, religion etc. But this does not fall under that. As you said, if you don't like the terms then you have the right to find another company. |
