TopDawg510 | Declare myself independent from parents? |
Is there a way I can declare myself as an independent (meaning my parents don't claim me as a dependent on taxes and stuff like that)? I'm not quite sure how it exactly works. I've heard I'm automatically considered independent once I turned 18?
The reason I want to do this is because my mother is disabled and is on medicare, and my father says that even though I'm 21, I can't get a job or else medicare won't cover her medical costs. First off, is that possible, because I'm slightly reluctant to believe my dad sometimes because he's really strong on the importance of education and really wants me to get my bachelors degree before getting a job...sounds really unorthodox nowadays since most people are getting jobs when they turn 16. So I thought if I declare myself as an independent, then I would be able to get a job without my mom losing her coverage. Also, I'm definitely going to be going to school full time, but just want some extra cash and some job experience.
Anyways, I'd appreciate any advice/answers you have.
Also, please excuse any ignorance I may have portrayed!
Thanks. |

Well, I'll point out the obvious: The easiest way to stop being considered your parents dependent is to move out of the house.
I understand that may not be feasible for you now, but I at least wanted to point that out. A 21 year old who lives on his own would not be considered a dependent of their parents, unless the parents were paying at least half of his living expenses.
As long as your parents are paying at least 50% of your living expenses, you are considered their financial dependent and they are able to claim you as a tax dependent. There is no "declaring yourself independent" - either your parents support you, or they don't.
You just have to start paying for at least 50% of your own living expenses (rent, groceries, utilities, school expenses, etc), and then you are "independent," legally speaking. |

If you live at home and your parents pay for at least 50% of your living expenses, they can count you as a dependent on their taxes.
Your mother's eligibility for medicare is based either on her age (65 or older) or a disability. Income does not play into that.
If however, she has medicaid, your income would be counted in the household income for eligibility for that and that could put her over the eligibility limits. |

it is my understanding that the parent has to claim that the child is a dependent, all they have to do is not write about you on their taxes, while you file as an independent as opposed to a dependent.
my parents and i agreed on me being independent, i don't know exactly what happens when there is a disagreement, but they can't make you be a dependent if you have a job and are living away from home.
Medicare covers a household up to a certain point of income. unless you are planning on making a lot, or your father is right on the brink, whether or not you are dependent wouldn't matter. but if you are independent, then your income will not affect her medicare. |

There are very good answers already here. But I think more info is needed. Is your mom getting medicare or Medi-cal? If she is getting medi-cal then your income would be counted but then so would your dad's and everyone else's that lives in the home.
If you move out or say you do not live there then your income is not counted since your over 18. That is why so many people cheat and say they do not live in the home when they actually do.
If your mom is getting medicare then that is a different story. Call Social Security and ask them about income.
And, isince your over 18 you are automatically independent. The question here is if your parents count you as a tax deduction on their income tax. If you want to be truely independent just do not have them claim you as a dependent on their taxes.
But I support what you dad says. Finish your school. It is your job to go to school and that's it. It's your dad's job to take care of your mom, not yours. You have a great dad that gives good advice. And you must be a great person too to care so much for your family. |

Nope, as long as you're not legally incompetant (like Downs Syndrome or some such), you're independent from them. You are an adult.
There's nothing to declare - you're 18. You're already independent.
You can get a job and move out of their house.
MEDICARE is not income specific. Medicaid, welfare health insurance, is. All people in the household, income counts for welfare. They don't even have to be related, so it doesn't MATTER if you're independent or not. If the guy next door moved in, his income would count.
But if she's on MEDICARE and not MEDICAID, then household income doesn't matter. |
