My wife was terminated in the state of Oregon. Her reason for termination was that she had too many computer entry mistakes. Does anybody know if she can be denied benefits because she was terminated for this reason? She has worked there for 3 years. It has been almost 4 weeks since she filed and they still state the claim is under review. |

She could be denied, and can appeal. If the company does not have documentation of any reviews, write-ups, or other issues she is very likely to win an appeal. The company has to be given time to respond to the claim. |

~~She can be denied because the employer is contesting the benefits allowance to her. So she needs to appeal the decision.
It is a work at will State which means she can quit without a notice and they can fire without a notice. However that does not mean she loses those UI benefits.
At the hearing, the burden of proof is up to the employer that your wife was given counseling or some sort of warning to make her aware of her computer errors. If they do not have documented proof then she will receive her benefits.
An employee must be given a chance to remedy their work errors before the can be disqualified for UI benefits. If she did not sign any warnings, she will win the appeal.~~ |

she will at least get the opportunity for an appeal hearing if she is initially denied and even if she loses, she MIGHT be able to apply again in 6 weeks - every state has it's own rules - my answers are based on Pennsylvania knowledge |

Oregon's rule is that she will be denied if she was "suspended or discharged for misconduct connected with the work". If she entered the data wrong on purpose, that is misconduct and she should be denied benefits. If she simply cannot type better and there was no misconduct, then she should be able to receive benefits. |
