The fire that started from my house spread to my neighbors and it burned their houses. The accident happened when I wasn't at home and the reason for the fire was electric leakage from fire examination. Then am I responsible for paying their damage of the houses even if it's not my fault? |

First, your neighbor should file the fire loss under their own homeowners insurance. Their company will investigate the loss & if they feel you are responsible, they will subrogate against your homeowners policy (liability coverage). Depending on your state statutes, your policy may or may not pay under liability. When your insurance company investigates your fire loss, if they feel someone else caused the fire due to negligence, they will contact that other party & ask them to pay what they paid (both your loss & your neighbor's if they paid on that) or tell them to give it to their insurance company for compensation, depending on what they have for coverage, their policy may or may not pay under liability (if they accidentally caused the fire, could be under GL - general liability, if there was faulty workmanship, unless they had professional liability, there would be no payment). Now if there was a faulty part of something, your company may go after the manufacturer of part.
This sounds like it could be long & drawn out. You should file your fire loss under your homeowners policy, your neighbor should file under his homeowners policy & let the companies figure it out. That is what they do, that is what you pay them for. If your neighbor waits for your company to pay them, it could be a long time because they have to fully investigate everything before they pay anything on liability. The fastest way for them to get repairs done, is file with their own company. YOU personally will not be responsible to pay them, your insurance company MAY be responsible to, depends on what I said above. You may have some out of pocket if you policy pays his company & if you do not have enough personal liability to cover the damages. Also, hopefully you have enough personal liability to cover their losses if it comes to that. If you have less than $500,000, raise it, get $1,000,000 if available - won't help you with this loss but is good for the future & it is cheap. |

You'll have to check with your insurance company to be sure - and it may depend on what state you live in - but I would think that it's something your insurance would pay for initially. They may go after the people who conducted the fire examination, which is who should be ultimately responsible.
I would definitely talk to an attorney who has experience with property law in your state, it seems to me that there might be a good case for negligence on the part of the examiner.
It's worth checking, since even if your insurance pays, you'll pay too - for higher insurance premiums. |

For Liability to pay which is what would pay there needs to be negligence, Now that is where insurance comes in, and the adjuster. There house would not have burned if your had not. If it pays it will pay under the same claim for both yours and there home so you should have 2 claims against you. Just a higher amount of payout. You should not have additional money out of your pocket unless you don't have enough liability coverage. |

No, responsible means "at fault". You are not at fault. THey'd have to sue you, but no lawyer is going to take this without $10,000 in fees, up front - because no court is going to find you at fault.
