Yes,, it is private property, denominated as common area along with the halls and other circulation spaces. Even though there are some malls that charge a parking fee, it still not likely that they have theft insurance, malls are free of any responsibility simply by placing banners that state they are not responsible for damage or stolen goods on your car. |

Ordinarily the parking lot is part and parcel of the property shopping malls purchase . Unless otherwise stated
by a sign or signs at the entrances of a shopping mall they have ownership and are liable in some way shape or form, in addition most if not all malls these days have video surveillance, and security guards (in reality) to watch for theft of their products and property first and formost.
You would have to go in and ask the proper people about their parking lot or grounds policy. Chances are there is nothing in their policy or liablity clause, for the most part to help or aide you.
But the video film might aide you with your insurance people.
If you had a problem with your car in a mall parking lot, the first thing you should do is call the police, then contact your insurance(perhaps they could get a representative there on the spot) then contact the mall people. With your insurance rep there the mall
will be more likely to show the parking lot video. |

Generally speaking the owner of the building owns the parking lot and they are the mall or the mall leases the space from the owner. There would never be any instance in which there liability insurance would pay for your car getting stolen while parked on their lot. You can try, but you are wasting your time if you do. Have you ever heard of the government paying for a car stolen of the streets?? Same prinicple. |

Regardless of who owns the parking lot it is up to the car owner to provide insurance of your car. They would not be liable. |

they certainly have the responsibility. if someone is attacked in their parking lot, or their car stolen then the mall may have been irresponsible in providing adequate security thus they are liable. |

Malls generally own their own parking lots, or lease the property from the developer. Auto theft is not their concern; it's up the customer to have adequate insurance. |

Most of the shopping malls I've seen, the Mall (ex: Simon Properties) owns nothing. They lease the buildings and the use of the lot from someone else (local building and lot owner). Sometimes the lessee (Simon Properties) is responsible for the lot, sometimes the building owner is responsible for the lot. This would be for maintaining the lot, ie, plowing snow, filling in potholes.
Their insurance does NOT EVER cover theft of an auto parked in the lot. No more than YOUR insurance covers your friend's car, if he parks at your house, and HIS car is stolen.
Sorry, you'll have to submit this through your auto carrier, if you have comprehensive coverage. |
