Subrogation is standard and nothing new. Wal-Mart's bad PR move to collect is what's new. As health care costs continue to escalate, this is what we'll see more of.

One wonders if the ATTORNEYS recognized what Wal-Mart was going to do because the $400+K that Wal-Mart paid out was probably regarded in the settlement as money the family was not "out." However, if Wal-Mart's going to collect that, then the lady is in the position where what was a "covered" medical bill is NOT covered. The award she got (less all those attorney fees!) was clearly intended for FUTURE CARE. Now, as usual, the taxpayer will be picking up the tab so the insurer can have his profits. THIS is the way the system is designed.

It has nothing to do with Walmart, it has to do with the healthcare provider. This clause is in almost all policies, so again Walmart is not being sneaky.

I hate Walmart and hate to stand up for them but this story was written incorrectly. It wasn't Walmart it was their health insurance company. They have to equally apply the policy to all people or it is called discrimination. Walmart's provider can't pick and choose who is more deserving to pay back the money won recovered for medical bills. That just isn't fair to everyone else.

If you want to complain...complain about the judicial laws that did not allow her to keep that money to compensate her for pain and suffering.

It's not Walmart, it's the HEALTH INSURANCE COMPANY. And it's not just theirs, it's EVERYONE's.

This isn't new. It's called "subrogation". That keeps you from double dipping - getting medical costs from both your health insurance and the other guy who hurt you, is double dipping. You're getting paid for the same bill twice.

If they don't, it is their own fault because it is up to you to know what is in your health plan, retirement plan, etc. If you don't agree with it - find someplace else to work that has a plan you like.
