Do i have to pay a deductible for a car accident that wasn't my fault?
I got into a car accident about 3 weeks ago and the person ran the red light and hit my car. DO i have to pay the deductible when it's not my fault? Please answer me soon i need some insight this would be my first car accident thanks.

If it is adjudged the other person's fault (police report, witnesses, photos, etc.), then his liability insurance should pay for everything. If his company is dragging their feet on paying the claim then call your insurance company and tell them you want to subrugate. Then your company will pay you off, minus the deductible, then settle with the other company. Once the other company pays for everything, then your company will reimburse your deductible to you.

But there are a lot of drivers on the road who either don't have liability insurance or, if they do have it, their coverage limit is too low and will not pay for all your repairs. If you have Uninsured/Underinsured motorists coverage on your policy, then your company will pay you.

You don't say what State you reside in.

If you are in a State that has a "fault" insurance system the negligent party's insurance company will pay for the damages to your car. You will not be responsible for your deductible.

On the other hand if you are in a State (i.e. Michigan) that has a "no fault" insurance system there are various deductible options available when you purchase your collision insurance. One of the options is a deductible that is applied in all cases, called regular collision. Some people go with that option to reduce their premiums.

Your insurer should recover the deductible amount from the other driver. However, it may take a while before you get it. In the meantime, you'll have to "front" the deductible amount. Been there, done it...

If it's your insurance policy, you need to pay the deductible, unless you have a "waiver of deductible" provision on your policy. Normally, that "waiver of deductible" only applies when the other party is identified, and has coverage.

If their policy is paying, there's no deductible.
