Do the "Owners" of a corporation need to pay WorkersComp?
We have 3 majority stock holders that are also employed by the corporation. Does WorkersComp apply? Operate in California.
Additional Details
I know it applies to the employees, but these officers own more then 10% of the company.

Mommy
No, the owners do not need to pay WC. They can be excluded from the policy. Please check with your agent for the guidelines and salary caps.

OK, the ownership of the corporation is irrelevant - all employees - even stockholders, even if it's more than 10% ownership - must be covered by workers comp, in CA. There are a VERY few exceptions for a few types of businesses - like a performing artist that is hired for a week of shows.

So yes, any ACTIVE owners that WORK for the company, must have their payroll included in the premiums.

Richard T
going over records of many large corporations, it has been found that all employees (even if they are stockholders) are covered under worker's comp even the owners of small businesses are required to maintain workers comp coverage insurance for themselves.

The corporation needs to to pay for worker's comp for all its employees. The owners do not pay, the company does.
