Tom is correct in his advice. To add to the information he has provided most independent insurance companies use a standard homeowners application form provided by a company named Acord. On this form the only question that is asked about criminal indictments or convictions specifically asks if (in the last 5 years--10 years in Rhode Island) you have been convicted or indicted of the crime/s of fraud, bribery, arson or any other arson related crime. If your husband has not been convicted of any of these listed questions, then I would not volunteer any additional information about his criminal conviction. If he has been convicted of fraud in the last 5 years (last 10 in Rhode Island) then you would have to answer affirmatively and your only recourse for insurance would probably be the FAIR Plan (the FAIR Plan is a state & industry sponsored pool for high risk property insurance) in your state.

Since it sounds like his conviction is over 5 years unless you live in Rhode Island this should not be an issue with most independent insurance companies. You might want to check with a Travelers Insurance Company agent since I know they specifically use Acord forms and therefore you would not have this issue.

You have to answer all of the questions on the homeowners policy application honestly. The only questions I have seen on a homeowners application that refer to previous criminal activity are questions like:
Have you been convicted of insurance fraud? And have you been convicted of arson?.

You do not have to, nor should you, volunteer additional information that is not asked for.

See, that's material misrepresentation. If he doesn't declare it up front, it can void the policy - which could be a big problem, if you have a large loss.

So yes, he has to declare it.

Two options: 1. go with a high risk insurer, like Foremost Insurance (although you'll pay a higher price, too or 2. get the house out of his name.

It depends on what he went to jail for. If your husband went to jail for insurance fraud then you must tell the insurance company.

Anything else, they probly do not have to know. So, it depends. You would have to say if it was for insurance fraud or not.

Call your Department of Insurance in your state for help.

eibbed, Home insurance covers lots of different things. I don't understand all the fine print of my policy, but my home insurance agent is always helpful. Try contacting your agent or a agent in your area. http://www.easyhomeinsuranceguide.com They should be able to help you.
