To start off my vehicle is under me and my ex's name. I have an insurance policy with my car and his car in the policy. So last night my ex completly went psycho and smashed my front car window and kicked my driver front and back door. I made a police report and they made the damages up to $1,000, I decided to press charges and so he is getting arrested once they find him. I wanna know how do I handle this situation with my insurance company or should I even bother ? since the car is under both of our names but he's only a co-signer and he's on the exact same policy as me ? HELP !!! |

If the car is titled to both of you (and odds are it is if he also signed for the loan) - then he has the right to break the windows out. Comprehensive will cover vandalism but it most likely will not cover him causing intentional damage to a car he has an ownership interest in.
You can report the claim. Your company will do an investigation and will determine if it is covered. If it is not covered - they will not pay you anything. We can't tell you what your insurance company will do. You will have to file a claim and find out. However, there is a chance that it will not be covered. |

Yeah, your insurance will cover it since you have police report citing the incident...just have to pay your deductible, prob. $500. So you'll want to ask yourself: Is paying the deductible and raising your insurance premiums worth it?
Or you can go to court, along with an estimate for the repairs, and during sentencing the criminal court judge can take into consideration the amount of repairs needed to your car and order the defendant to pay you for those damages.

You should really contact your insurance agent about this. You need to take your ex off of the policy anyway, while your at it ask about this claim. |
