I have a better secondary health insurance from my spouse. I tried to drop my primary insurance, but I have to wait a year by law to drop it. I went to the hospital for a MRI. It would cost me $600 dollars with my insurance, or cost me $300 dollars with the secondary. I went the cheapest way. DO I HAVE TO USE THE PRIMARY? Is there any kind of law the I have to use the primary first? I have got my medications with my primary, but my spouse did send the co-payment bills to the secondary insurance to get some money back. |

Yes, you have to use the primary insurance.
A secondary insurance company won't pay anything until they receive a copy of the EOB from the primary insurance company. They need to see what the primary paid in order to determine what share they (the secondary) will be responsible for.
After your primary pays, you can have a claim filed for the secondary insurance to make payment towards the remaining balance. (according to your benefits)
You're making this more complicated than it needs to be - yes, you have to file with the primary insurance. However, if your secondary insurance is "better coverage," then they should pick up at least a portion after the primary anyhow. |

You must use your insurance as primary for you. Your wife's insurance should pick up the balance (usually) up to what they would have paid if primary, so your out of pocket costs should be the same as if you billed hers alone. |

You do not have to use any insurance. You could pay for the entire cost yourself, instead of just the insurance copy, but it will cost more.
To use any insurance, you must use the primary. The secondary covers only the difference between what the secondary would cover if it was the primary and what the primary does cover. Also, if you have, but do not use, the primary, then the secondary might not cover anything. |

Yes, the primary pays first. Then you can ask the provider to file with the secondary, which may pick up a portion of what the primary did not pay.
