Does a certain party have a right to sue?
Company A (me)
Company B (my client)
Company C (pass through company that has a relation ship with company D)
Company D is the fiannce company that financed the sell for Company "C"

"A" sold a product to "B", "C" financed the sell thorugh "D"
"B" rejected the product, "D" wrote the sell off
"C" wants to sue "A" for the cost of goods but "C" has never paid any money out of pocket for said goods, Does "C" have the right to sue "A". AFter "D"has written off the sell?
Additional Details
If the money was not paid "C" but to the manufacturer of the product, how can "C" sue "A" as "C" never paid for anything nor recieved any funds in reference to this transaction. "D" wrote the loss off and "C" is now trying to sue "A" for monies that it never paid out.

In an application regarding the right to sue, certain statutory provisions are applied in the Tribunal’s determination of whether a right of action is taken away by the Act.

For accidents occurring after January 1, 1998, sections 26 through 29 of the Workplace Safety and Insurance Act (WSIA) are applied in making this determination.

For accidents occurring prior to January 1, 1998, sections 10(9) and 16, and its related sections under the Workers' Compensation Act 1990 (pre-1997 Act), as well as the predecessors of these sections under the earlierActs, are applied in making this determination.

Section 126 of the WSIA requires the Tribunal to apply WSIB policy in appeals; it does not specifically refer to right to sue applications. Nevertheless, the Tribunal requests policy for right to sue applications filed with the Tribunal;

Yes, because that writeoff, either resulted in collections actions, or resulted in a taxable income.

As long as C has a monetary loss - which it does - it has the right to sue.
