clayblasdel | Does an insurance company bear any responsibility to remove a giant dead tree BEFORE it kills somebody my yard |
A huge old willow tree has a rotten core and will collapse soon. Its sister tree collapsed a few years ago. If the tree kills someone or damages the house, my insurance company will likely pay damages. I think the insurance company should pay part of the cost to remove the tree before it hurts anyone. Shouldn't the insurance company pay to prevent damages? |

No, they are not a property management entity. YOU are the property manager, and it's YOUR responsibility. Also, if it does kill someone, and you expect the accident, and don't do anything to prevent it, they don't have to pay out under the liability section (although I've never seen that invoked for trees).
The damage to your house would be covered, the removal of the tree usually is only covered up to a small amount depending on your policy, $250 to $500. You have to cough up the rest.
The insurance company is not a maintenance contract. They won't shovel your sidewalks to prevent slip and fall accidents, they won't mow your lawn to prevent rodents from moving in, they won't clean your house or take out your garbage to prevent rot. The policy is intended to provide for sudden, accidental, and unforseen problems. If you neglect to upkeep your house and yard, more likely than not the company will be out there to inspect at your next claim, and demand you to correct deficient conditions or they'll cancel your policy. |

Nope, the tree must fall and kill someone before they will pay you anything. |

You have gotten good advice in the other answers that said, "Get it cut down." You should definitely do that.
I know it seems like a waste to have paid your insurance premiums all these years just to have someone say you need to spend more of your money.
Here is why that is so. The insurance company and our society as a whole expect you to act "responsibly". If you know or strongly suspect that the willow is rotten and will fall soon, it would be "irresponsible" of you to just let it happen. Insurance is intended to protect against unexpected events - not those you expect.
Best wishes. |

No it is up to you to have it seen to before it is too late. |

Its your responsibility, and if it falls they will probably come out and look at it and tell you that they won't pay because you should have had it cut down.... |

An insurance company pays when a covered peril occurs. as of yet no occurence has occured. A peril is either fire, falling objects etc. If insurance companies paid for issues like yours all of our premiums would be at least double what they are now. Insurance is not a maintenance policy. It covers sudden and accidental incidents. Now pay someone to cut your tree down before you get cancelled. |

thats like saying the insurance companies should pay to have all the levees redone in Louisiana.
Better have the tree removed. If it does fall and hit someone or something and your ins. pays....your rates are gonna go up. |

if your in time of renewal some carriers have a right to inspect the premises in Connecticut, evry state has different laws, but in our state they can exclude any damge from that tree, or ask you to remove the tree before they renew.... |
