Here is a story .I hired a guy to cut down a tree in my backyard The tree fell down on my garage and destroyed my garage and its' content.The guy ran away and disappeared.I put a claim on it and adjuster came up to estimate the scale of peril.He tried to pretend He is very nice guy and wants to help me out He said if you give us any clue about the tree guy we would wave your deduct ale from your claim I looked up everywhere but I couldn't find out his business card The only thing I got was his cell phone number after a while adjuster tried to locate him but He couldn't and he said I am sorry We MUST deduct from you claim -(if I had his name and address and They still couldn't get the money from the guy in that case Should they deduct that portion of my policy or since I gave them the contact number and his first name I MUST be fine and the 1000 shoud'nt deduct from my policy?)

I assume you are talking about the deductible on your HO policy. The adjuster did nothing wrong! The bottom line is the tree fell and damaged your garage. It doesn't matter who caused it. It was an accident and the deductible applies. However, if the adjusted could have identified the guy AND the guy had either insurance or money to pay the insurance company back what they paid you, they would give your deductible back. I hope you learned a lesson in only contracting with legitamate contractors with insurance and a license! |

Here's my 2 cents worth. I can't imagine any adjuster saying they would waive the deductible in exchange for some contact information. The adjuster handled the claim in the proper fashion. The deductible is deducted from the payment no matter what. Period.
The adjuster was trying to get the contact info needed to seek reimbursement from the tree-cutter or his insurance company (if any)
I suggest you do whatever you can to locate this guy to better your chances of getting the $1000 back through subrogation.

When you have a covered property loss, your deductible applies. The adjuster asked you for the tree guy's contact info so that he could put him on notice that your company was going to "subrogate" against him, which means, attempt to collect the damages they paid plus your deductible. If the at fault party cannot be located, you unfortunately have to pay your deductible no matter what. If your company finds the at fault party AND is able to collect the damages either from him or his insurance, THEN, you would receive your deductible back. I hope this helps. |

In most (or even all cases) your deductible would apply. The adjuster was being super nice by possibly waiving your deductible, which they can do under certain circumstances. |
