Does anyone knows how long a life insurance can take to process on a claim....It has been over 5 months ......
I know I asked this question before. However, that was probably 2 months ago.....and still no payment. The insurance says the police have not cleared me, the beneficiary, of any involvement of the insured death yet. The police have not talk to me for 4 months. In fact, they are avoiding my calls. Is there any rules regarding insurance company paying out only if the police find the suspect or convicting the criminal? I voluntary took a polygraph test a PASSED, and the insurance company told me the police have not cleared me yet!!! Come on!!! The policy was over 3 years old. I am in the process of requesting help from the State Ins. Board or Commission. However, they seem pretty busy...they have not assign me a person to help me yet....been 3 weeks. They said give them 45 days to reply. I know ins. co. suppose to pay within 45 days. This has been almost 6 months. Patience is a virtue!

Check with your state laws on timely payment of claim, but, no, until the police clear you and you are no longer a suspect, then you will have to wait. This is a problem with you and the police, not you and the money coming to you. You need to work to clear your name first if you are innocent. Work on that, the insurance company will pay you as soon as you are cleared. That is where you should be concentrating your efforts.

You need to carefully consider getting an attorney. Insurance companies do not care about your problems and are not in the least scared of you.

It's unfortunate that you are in this situtation.

But the insurer has every right (and you as a policyholder of the company has an expectation) that not a dime of our premium money be paid out unless they are certain you did not cause the death.

There was a very high profile case here in my state where a husband pretty much got away with murdering his wife and yet he had to sue the insurance company for the life insurance.....the case took almost four years....he eventually won....but it was clear by the circumstances that he was involved and still got the money.

Insurance companies do not pay out on life insurance policies until they get their hands on the death certificate. If the death certificate has not been issued by the ME/Coroner's office they will not pay out under the policy. They will wait for the certificate because 1) they need to know the cause of death (homicide, suicide, accidental) and 2) because the cause of death may be an excluded under the policy.

To answer your question as to when you'll get paid--when the death certificate arrives; depending on what it says will determine when you will get paid, if ever.

You'll need to contact the ME's office to find out what is taking so long. It could be something as minor as the ME hasn't signed the certificate yet. This is not a process that will be rushed...especially by or for you.

Contact an attorney if you like, but you may want to make sure it's a criminal defense attorney.

No, I don't believe so!

I would DEFINATELY wait the 45 days, though. Insurance companies do NOT have a time limit in which they have to pay, ESPECIALLY if the police have not cleared you yet!! Actually, they have an obligation to NOT pay you, until you are cleared of suspicion.

Sorry, you'll have to wait!

You could try hiring a lawyer, but I doubt they could speed things up, AND they'll take 30% of the policy procedes.
