Hi, My brother was recently hit by a lady when going around a round about. He was obeying all road rules but she did not se him when she entered the round a bout. He has no personal injures besides some cuts and grazing. However he has an expensive bike and when he got it assesed it was estimated the damage bill would be $1000. Is it possible for her to claim that on her insurance?

If the lady was at fault for hitting your brother on his bike - then your brother will be able file a claim against the drivers liability insurance. They would probably be willing to pay him a small injury claim for the cuts/scrapes as well. |

Definitely. Her insurance should cover the damage to the bicycle. He should contact her and ask to be paid. If she refuses, he should hire an attorney. I hope a police report was made of the accident as it gives more credibility to his claim.
Even if she does not have insurance, she is liable for the damage. |

You can't claim it on HER insurance, but you can sue her for it, then her insurance policy will pay the PROPERTY DAMAGE. Or, she can report it directly to her insurance company, so they can pay.

Yes, and she does not have to have collision insurance, not would it help. Collision insurance covers damage to the insured vehicle in a collision. Damage to a bicycle owned by a third person is part of the "property damage" portion of the "liability" insurance required to register or drive a car. Most states require at least $10,000 of this coverage. Cuts and grazing are covered by the "bodily injury" portion of the "liability" insurance required to register or drive a car. Most states require at least $25,000 of this coverage. |

Yes you can hit a tree, fence, other moving vehicle and get compensated as long as she has good insurance.. Pray that she does!half the time they don't or give you a phoney insurance company and your left paying for it yourself. |
