The girl that parks right next to me in my apartment swiped the side of my car. she is now claiming her friends park her car sometimes, but she knows she didn't hit my car. Personally her car is her responsibility and I feel like even if a friend of hers was parking when the incident happend, she is responsible for damages because its her car. Would she be responsible? Can I take her to court if she doesn't have insurance? And if she does have insurance would they cover this? I also have good pics. |

She would be responsible. Even if she wasn't driving, it is her car, her responsibility. Insurance should cover this. That is why you have it. |

It is good you have photos.
Step #1 is to call your insurance company and put in the claim. If you have collision coverage let your insurance company fix your car.
Step #2 give your insurance company her neighbor's license plate number so they can contact her asking her for her insurance info.
If she does not give her insurance info then your insurance company will give you your deductible money back if you have uninsured motorist coverage.
Check with your claim rep. Laws vary by state. |

Well, it depends.
You can usually go after both the OWNER of the car, AND the driver. So if you don't know who the driver is, you can always go after the owner. Does the owner have insurance? I have no idea - but you can ABSOLUTELY take her to small claims court and find out.
If it were me, tell her, you are the owner of the car, you are responsible for the damage it does. Please turn this in to your insurer. If I don't hear from them in a week, I'm going to be forced to take you to small claims court, and then you'll have to pay for court costs and my rental car, in addition to the damage your car did to mine.
Yes, the insurance would cover your damage, AND a rental car while yours was in the shop. |
